It depends what avenue they wanted to take. They could probably easily achieve a settlement given the evidence and the fact Bungie themselves admitted to stealing the art, so it would really only be a question of if they could crowdfund enough money to pay for legal representation and if the settlement amount would be greater than what they spent to get it.

I still doubt it'll happen though. Most sane people don't want the hassle of dealing with the justice system, even if they've got a slam dunk.
 
Wipeout has a similar aesthetic, but they actually hired the originator of the style (The Designers Republic) to design everything from the ground up and this game designs' are still considered legendary today.
Instead Bungie chose to copy twitter troonslop instead of designing it from the ground up. Especially how it doesn't Marathon, which wasn't known for this kind of look. It should've been a new IP.

In the same way as WipeOut did in your comparison, if Bungie had decided to hire even the troon directly, you would have still certainly wound up with something that looked far better just by virtue of actually being coordinated from the start. Sure, it still wouldn't have been Marathon, but you would have had a far more consistent, cohesive and purpose-built style all throughout that wasn't just existing standalone posters glued together everywhere with no tact. This very well could have been an "AntirealTheGame" as was already joked, but it would have also been that without looking like it was made as an unlicensed fucking bootleg.

So this is why the art style, even separated from the game itself, looks like shit. I had this thought that if the game wasn't branded as Marathon the art style would be fine, but after looking at more of the game and thinking about it longer the style still looked like shit and just didn't mesh well. Just look at the environments being hyper-sterile and the shitty overdesigned "punk" characters, they do not match at all.

Please don't get me wrong here. the reason I spoke about it in that way because the way Marathon used the art by just picking the images off online by itself (as if just picking anything interesting off twitter and pinterest), and therefore it didn't go through the process that you both described - where the artist could designed the whole thing from the ground up like Wipeout, this was the argument that I made, if they wanted to use that style so much, it'd be better if they'd hire him.

In fact I actually praised Antireal to actually be more original/unique than most 'Y2K wannabe art' today. There's also the fact that most of the best works N2/Ben Hook put out was before the time he transitioned - so it's Celeste debate again. I would say that Antireal 'as a whole collective' probably influenced a lot of Y2K revival style we have today like David Rudnick sparked rave-poster chrome typography that became popular in the late 2010s. And Antireal and Billain works are more up-to-date and inspired for modern technology rather than being a fully imitation of late 90s - early 2000s style

Maybe I'm a ' histrionic reactionary retard'... - but there's my personal point about this specific one artist of the collective becoming part of 'that demographic kiwi likes to bash' - I do think it's a bad thing to happen to art and culture when people troon out as it became harder to discuss the works and culture surrounding it due to them being 'protected by ideology'. Cyberpunk in general discuss about the affect of alienation that how people self-destruct to cope with the enroaching technological systems that became too unbearable for individuals, and there's part of it that became more real to us than it was back then. The whole situation became farcical. How an AAA giant devolved into stealing some artwork someone posted on the internet sloppily, as if people aren't going to notice, to the artist who shyed away from public to end up identifying with imaginary labels to mark himself as 'inherently different' from the rest of humanity and the way 'gender is a costume', etc.

Lawsuit is not cheap or easy to win especially if you're against big companies, but this is probably the most clearest and easiest example of asset theft compared to most claims when it comes to intellectual property - so it's technically one of the easiest case to win in technicality, especially now that the the public are on your side. Since he's associated with someone like Billain (Which is not no-name - this is wikipedia blue name artist) then you can get a lot of connections and you'd better act presentable. So I wonder why would the artist dissociation into 'identity culture' like this and slowed down their output.

It's almost as if when I said on page 1 the game looks like uninspired slop that I was correct, good to know I can trust my lying eyes. But not just uninspired, that would be the original troon artist, they lifted the uninspired slop artstyle completely wholesome, amazing.
Seems like it's taking place in parallel with the first game, possibly the 2nd game. Considering how there's more than half a dozen timelines, there's a lot of possibility for the lore.
I've also been proven right that this literally has nothing to do with Marathon at all besides being a familiar IP that Bungie still owns that they can milk dry using its name. Although I'm not sure how many actual Marathon fans this will convince, if I wanted a new Marathon game, (I don't) I would want it to be a singleplayer FPS with emphasis on large/cryptic level design, and strong storytelling. Not a cut/paste extraction shooter. I don't want to dunk on @ScurvyRat too hard since I think his heart is in the right place when he went through my first post; but it's okay to be a fan of something and still be critical of it. I would say that's a much more healthy way to have a relationship with media. As a Marathon fan, I would love for a new game in the series to be good, but I've been given no evidence so far that this will be anything other than a tirefire that will be forgotten and unlisted from the big game stores within a month of it releasing.

Awoken are the newmans, Exos are the CAST and humans are humans. Though the race choice of the player actually matters in PSO.

When they first announced a new marathon game I was expecting something along the lines of a doom(2016) revival for it, but that takes actually enjoying the game that you're trying to revive and not being a hollowed out husk that exists to only make infinite live service garbage for corporations.

I see a lot of people saying that "the art-style was the only redeeming factor" of this game, but the art style sucked hot ass. It's a texture-less, visibly noisy, in-cohesive mess that doesn't even attempt to look like its source material.

The artist they copied from had a lot of style that was ripped off of other garbage. The only reason people are sympathetic towards them is because they are looking for a reason to shit on Bungie (which is a good enough reason). Otherwise, the art is the same soulless, sterile slop that has failed for the past 6 years.

That would actually be effort and they'd need to pay the troon his fair share; something which Bungie seems to be allergic to these days.

Considering some people are still seething(behind a poorly hidden veil of "irony" of course, as you do) now that this game was exposed for the soulless husk that it is(when me and others called it out for what it was the moment we saw it) makes this absolute trashfire all the better. I was spot on when I said this whole thing was just some troon copying it's favorite cyberslop aesthetics aimlessly(and then another troon copied that troon).
It's almost a shame nobody will play this, I want to see this game suffer for months but I doubt there will be an active enough playerbase for it to even last that long.
All they had to do was make a game where you play as a guy who shoots aliens, maybe give it a kind of gritty military art style? Its a shame, maybe they should have gotten the Halo guys or something...

At this point, I think modern day Bungie would actually do a worse job than 343i if they had rights to Halo. At least 343i has some sort of an autistic vision for the universe, it's not a good vision mind you but at least someone gives enough of a shit to write all these books and comics nobody reads. Nu-Bungie Halo would just be Maratroon all over again, GaaS POS like Halo Infinite's multiplayer client but somehow worse.

This is slowly following the same path as Radical Heights from Boss Key.
not really, radical heights was a hail mary from a dying studio, and from some of the feedback back then some people actually enjoyed it - it was just wholly unfinished and the studio died before gaining a sustainable foothold.
and even if you didn't like it you it was used to make fun of cliffyb.

people don't even use marathon to shit on bunghole since they've been shit for years, literally no one cares about marathon.
