Not a lawyer, but my take is this:

1. Becky has never been Daniel's "spouse" - she is married to someone and can't have multiple husbands legally. That would be bigamy.
2. As such, he can't owe her alimony at all.
3. Her husband (Jackson) is on the hook for supporting her and the child. Whether or not the baby is genetically his is irrelevant.
4. I don't know if Jackson could get a divorce on grounds of not wanting to support a child that isn't his. Probably not.

There is no legality for the "marriage." Polygamy is illegal in the United States. As far as I can tell, the only legal tie Daniel has to Becky is through Hannah. So I hope he gets sole custody of her.

Common law marriage exists in only a few states, and California is not one of them. (Colorado, Iowa, Kansas, Montana, Oklahoma, Rhode Island, Texas, Utah, and the District of Columbia) EDIT: And wouldn't matter even if it were legal in California, because polygamy is illegal.

You don't need grounds, as such, for a divorce in most states, and particularly not California. If Jackson wanted to divorce Becky, he could get the process started at any time he pleases and she can't say anything about it.

Wonder if reaching out to his friends will be escalated further for an extinction burst like @Larry David's Opera Cape mentioned. Interesting that she’s deactivated her blue sky right after reaching out. There’s definitely a group chat making fun of her right now.

Also it’s a really bad look, her going on to further elaborate how much Daniel’s friends make every year when she’s bitching that they didn’t join her crusade. What the fuck does that have to do with the price of tea in china? Wonder if she thought her dry begging would be pitiful enough for one of his friends to offer money. The California Bar is notorious for being the most difficult bar exam in the United States. Sadly, we can’t access Jackson’s attempts — but I’m sure Jackson, who went to a law school ranked 169 and that had an average LSAT of 151 when he would have been accepted (a very shitty score that only shitty schools accept), failed the CA bar more than once. He wasn’t admitted to the CA bar until 2016.

She's massively materialistic and spoiled and deep down, she knows this. She loves the poor LARP but the idea of being actually poor? Horrifying. Living off of 150k in CA is very doable for a family of three (if they stopped letting the other leeches leech), but she won't be able to DoorDash most meals or buy expensive clothes/tchochkes and might need to (gasp) cut down on the weed.

So, to her, their salary is pertinent. She's fixated on losing her 270k per year cash cow. When she said she doesn't miss anything except his money - that was a slightly mask-off moment (although she also misses being In Control).

Becky doesn't love a damn thing on this entire planet except STUFF. She loves the "commune" thing as long as it wasn't HER money being spread around, and as long as most of the "spoiling" was focused on her. Not that it would ever happen, but it would be interesting to see how freely she shares money she herself makes. I'd bet when she HAD a job, Becky's money always belonged to Becky and Becky alone.

May allah spite us, but there is some legal document that says EuroCuck is the legal father and CaliCuck is the legal husband. IDK. I'd kill myself before getting nearing anything like this.

The only way to know would be to get a copy of the birth certificate; and this may be a shock, but California actually does a decent job of gate-keeping certain pieces of paper, like birth and death certificates. To keep it simple; you either need to be a blood/surviving relative, a domestic partner, or court appointed agent. And I'm not saying anything about a gay op, but just because she put the thought out there, about the gay 3-way certificate, I just want to look at what Hannah's birth certificate says. Jackson is Becky's legal husband, Daniel is the genetic supplier, and they apparently have some special three-parent birth certificate. I just want to look... ... ... and see how California is gonna ruin Becky's life with the split.

CALIFORNIA: A 2013 law says courts can declare that a child has more than two parents and consider them all in custody, child support and other contexts. It was prompted by a case in which a troubled lesbian couple’s baby girl ended up in foster care, and her biological father lost a bid to be declared a third parent as he sought custody. The law’s sponsor said it gave courts leeway to look out for children’s best interests at a time when families are taking on new forms. Opponents said it eroded traditional parental roles and would allow people to “parent by committee.”


Three Parents​

A three-parent family might seem unusual, but it is a family dynamic many children are experiencing. For example, a same sex couple could have a child with a sperm donation from a relative or close friend. The three adults may decide they’d all like to be involved in raising the child. Because of the 3rd parent law, that scenario is now possible and protected under the law.

The “3rd parent law,” California Senate Bill No. 274 provides protection for children and families by recognizing the legal rights and responsibilities of two or more adults in the life of a child. This law offers many benefits for families who have or want more than two legal parents. It provides legal recognition for adults who are acting as parents in every other way. It can also protect non-traditional family structures.

Could a Non-Intended Parent Assert Legal Rights?​

The concern of the 3rd parent law is that it may allow a non-intended parent to seek legal recognition and assert legal parental rights. For example, if a couple uses a sperm donor but intends to only have two parents, could this law be misused by the sperm donor to seek parenting rights over the objections of the couple? This scenario would create chaos for most families.

The reality is that most parents don’t welcome additional adults interfering in their child’s life or making personal decisions about the child’s daily life, health, schooling, and future. Under the specific phrasing of the 3rd parent law, an unintended parent could claim parental rights. This can happen even if a child already has two responsible and dedicated parents. The court may find a child has three parents if there is an existing parent-child bond with more than two people. This can happen even over the objections of two of the parents.

It is important to understand that the 3rd parent law does not require a child to have more than two parents. It does not automatically create more than two parents but allows a court to find that a child may have more than two parents.

Protection Against Non-Intended Parents​

The law is intended to protect families and children, not increase stress for children and their families. Parents can protect against possible 3rd parent challenges by setting up a binding legal agreement between all involved adults before the child’s birth. The best way to protect against unintended parents is to seek advice from a California family law attorney prior to entering into any parental agreements with potential third or even fourth parents.


California, like most states, creates a presumption that the man married to a woman who becomes pregnant is the father of the resulting child for all legal purposes. That presumption can be challenged by the husband or the biological father, if done within two years after the child is born, to allow the husband to forego parental rights and responsibilities or to allow the biological father to gain them.

Unlike most states, California law specifically allows for a third option: SB 274, signed into law in October 2013, permits courts to declare that a child has more than two parents for all legal purposes such as custody and child support. The statute was passed after a lesbian couple’s child ended up in foster care and the biological father tried and failed to gain custody, and was intended to allow the law to keep up with the growing trend of non-traditional families.

While the husband was certainly presumed to be a father to the child per longstanding law, the appellate court in C.A. v. C.P. found that the biological father also satisfied California law for a “presumed” parent. The court explained that while the biological father missed the window for challenging the husband’s presumptive parentage via paternity test under one statute, he did satisfy a separate provision where a person acts like the parent. Per section 7611 of California’s Family Code, the biological father “receive[ed] the child into his or her home and openly h[eld] out the child as his or her natural child.” Where more than two parties otherwise satisfy California law for a presumption of parentage, SB 274 allows a court to find that a third parent exists in the “rare case” where such a finding “is necessary to protect the child from the detriment of being separated from one of his or her parents.”

The court noted that the case may have been different if the couple had consistently excluded the biological father, but in this case, they allowed him to act as another father to the child for years. Depriving the child of that other father would not have been in the child’s best interests.
