i dont understand what rekieta was saying on the female horse podcast. bodycam footage of criminal arrests is FOIAable in the United States of America. unless it's somehow different in Minnesota, which, im not a lawyer, but then again neither is he, I've FOIA'd bodycam stuff before on a felony case, and they withheld it until post sentencing and then simply charged me for their processing and editing fees to blur any victims. am i missing something here or is this crack ghoul just once again a complete fucking retard?

Under Minnesota Statutes, such data is generally nonpublic until the investigation is closed or the case has been resolved in court.
Even then, certain footage may be redacted, withheld, or delayed due to privacy concerns.
Any footage of the children should be (and I agree needs to be), censored entirely. They are victims. The adults are not.
Even more then, Nick will fight tooth and nail when notified of the request. Only with heavy legal pressure will Null get it released.

so im just glancing at it here, and it is in fact under "Minnesota Government Data Practices Act" which is obviously a separate entity for the state, but im skimming over the prerequisites and it reads exactly the same to me as what i had to cover when i FOIA'd the footage i mentioned above. nothing in the rules suggest that the public won't have access to this so long as the proper fees are paid to blur any kids or unrelated persons on said footage. but i really dont get how this guy thinks april or the state would need to bamboozle him to obtain this. seems like a pretty open and shut records request if you ask me

edit - it made perfect sense to me while the case was still ongoing to withhold said footage. any time something that is being used in an ongoing case is requested anywhere they automatically shut it down afaik.

btw to clear up some stuff

• We have two Minnesota attorneys willing to represent us in this for nothing except any travel expenses, which I can pay out of pocket.
• We will probably win fees for these attorneys if we do have to sue because we have gone through "the process" to establish we are in the right as firmly as possible.
  • Pro bono attorneys are still entitled to reasonable fees if awarded fees regardless of how much they are paid, if anything.
• It is currently unknown to me, if they do deliver the footage, if I will have to pay for their time to redact the footage, or how much that will cost.
  • The clerk had previously spitballed us $5000 in estimated cost for the forensic team's time to redact the footage, however
  • The situation has changed substantially and I don't think it will take that much time or cost that much anymore, but
  • The footage we receive will be redacted -- I think only to censor minor persons though.
  • I am still committed to donating any leftover money from the $6000 to a charity. My current pick is the Zero Abuse Project.
• We had to wait a full year because one of the things we were waiting for was the adjudication of the criminal case, which is now over.

P.S. I have not touched that $6000 in the year I've had it.
