Considering how the judge has been tardguarding thus far, I'm going to guess that he'll opt for case-ending sanctions in the combined motion for sanctions and moot the motion to dismiss. He won't have any further monetary sanctions beyond the ones he's already issued since he went for the most severe sanctions, terminating the case.My understanding is that if the case is dismissed the docket becomes figuring out the penalty fees
The reason will probably be something along the lines of Rusty's discovery misconduct limiting him to the witnesses and evidence he has already disclosed: none. As such, he will be unable to present any witnesses or evidence, and he must dismiss the case with prejudice as a result. Because sanctions are at the discretion of the Judge, it is unlikely to be appealed by the 10th, so it's better than dismissing on a motion to dismiss, which is more likely to be overturned due to the very liberal pleading standards the 10th is using for pro se retards.
