I forget her channel name, but pretty sure she had a moment in the Destiny thread (since he flew across country to bone her, years ago). She was also the one that people called the female DSP and did the "FIVE! DOLLARS!" But home girl was like, in her Master's for Chemistry or some other big brain type science, and decided to just drop it and become a streamer; and by streamer it's lounging around and spewing progressive talking points with occasional gameplay. The Internet and websites that presented money for low effort has done a number on modern women.

Because while one side sucks, the other is a legitimate threat that needs to be stopped. The enemy of my enemy, yadda yadda you get it. I'm not on his "side" per se, but I hope the e-thots lose more than he does. And since he is a Jew in a court case, that's basically guaranteed.

It won’t be. He’s suing on the three strongest cases. Even if he only sued one of them, the court isn’t going to penalise him for not suing the other two. If you gotta case, you gotta case, even if you also hate the defendant. He’d only have trouble if he was bringing a frivolous case, and that’s not the case here.

It’s true, H3 is clearly going after them as Hasan orbiters and promoters (in Denims’ and Frogan’s case) of disgusting lies to destroy his family and harm his kids. It’s proxy warfare. But he also has an entirely legitimate IP complaint against them. Courts will just shrug and say, don’t give your enemies ammunition, retards.

It smells like a textbook infringement case with very solid evidence of copying, non-transformative use, plus an intention to deprive the copyright owner of royalties and diverting the income to the defendants. Let’s watch to see the defence, but prima facie he has them bang to rights.

You’re right, it’s not determinative on its own and doesn’t knock out a legit fair use defence. But it is helpful if there is no transformative use, and the defendants try to argue they weren’t trying to act as a market substitute for H3’s video.

Disclaimer: I haven’t read the full complaints yet, and there’s a long way to go in this litigation, but… I doubt it will set a legal precedent per se. He doesn’t seem to be arguing a novel interpretation of fair use. The effect is more likely to be practical: Twitch will be worried about future litigation against its creators and itself, and will ask Hasan to sit in his fucking chair and mumble something instead of wandering off for titanic shits midstream.

Let's get something straight, none of these women represent a legitimate threat. Even guys like Hasan, XQC, and Asmongold whose lazy react videos have enough views to get the attention of larger copyright holders to fuck with internet video content some more can fall back on their comments as transformative and, in doing so, make the case much more difficult to prosecute. Which is probably why they haven't been successfully sued.
These three were just lazy by even those low, low standards, and also retarded enough to state they were doing it to deny the plaintiff views and steal his content, while asking for payment on top of it.

I don't know about XQC but Asmongold periodically pauses the videos to offer his barely sentient ramblings and he does do consistently. So he has all his bases covered and can easily call his reaction videos transformative. Playing the whole video uninterrupted with no commentary is just not the same thing. There is a low bar for commentary - even playing clips with the video title being the commentary per the sargon verdict - if you can't even do that much you brought this on yourself.

I also liked the arguments he included from denims at the end of his video, about curation and the community aspect.. like she's not wrong when she says people wouldn't have watched it on their own, twitch viewers NEED to watch things through their streamers reaction, it's never enough to just watch the original video themselves, that's far too lonely. Assmongoloid's whole career is a testament to this, as are 80% of streamers, nobody's hands are clean from this reacting culture & parasocial farming.

Also her admission to siphoning views was after she was done reacting to it

XQC apparently argued with Ethan about this previously(fair use) and he was making points how Ethan's argument boils down to wanting people to REACT HARDER

i dont see many posters going through the actual docket filings, i just took a look and i see a bunch of sperging about snark reddit users and there being links to Destiny VOD's and other 8 hour videos in the many many footnotes.... he said he wanted to sue the snark reddit at some point & i'm pretty sure that never came to fruition, it looks like he recycled and shoehorned a bunch of that stuff into this Denims complaint

I was referring more to Hasan himself (or rather, what he represents), and targeting his biggest orbiters is a good way to demoralize him even further than he already is considering his situation with law enforcement
 
Not sure if this will be considered the greatest triumph of the Jewish people this year, or if the Israeli-Iranian war will, but I propose this should be it.

The other two I don't care about but I hope he manages to fuck Frogan over hard, she is a fucking vile human being who is not only harmful but wilfully malicious with it, I always try an find something good in someone (mostly for my own mental well being) but she is one of the very few people online who has nothing about her character that is admirable or worthy of respect - fuck her an the horse she rode in on.
