The reason MMOs charge per expansion is because each expansion is years of work on an ongoing basis. It IS double dipping but it's fairly reasonable especially because the subscriptions are essentially subsidized by the game makers; the real price to keep the lights on would be much higher per player.

I'm sorry but in my opinion there's no justification.
When WoW is raking money hand over fist, they don't need to charge the box price, they can turn a profit fine with sub-fee and MTX. But if gamers are willing to pay the additional price, why turn it down?
There's plenty of other MMOs that let you in the door for free, and give most if not all the content out for free, and manage to survive just fine. Blizzards approach comes down to greed and monopoly in the MMO space. Besides, any company that charges you to move a character from one realm to another has stretched their credibility on fair pricing, in my eyes.
Even if I'm wrong about those poor destitute MMO dev studios, which is possible, if SKG results in new laws forcing publishers to refund the box price after revoking access to an MMOs "service", I suspect publishers will just stop charging the box price anyway. That or they will offer a refund.
