I think it's brinksmanship. Back in the 60s and 70s, even conservative judges enforced desegregation once it came down from the Supreme Court, because that's just the law at that point. I'm not asking for politically neutral judges—you can take people with a good track record for your ideological beliefs. Just make sure they actually know what they're doing first. You can do that by choosing state court judges with proven track records in complex litigation.
