I get five kids, maybe all with college dreams, can be very expensive; but doing some investing with a 529 Account at birth or when they're still young at least; yeah you get up front costs, but by the time they're college age, that money turned into something more to help cover the costs. If Celeste is having a part of it, Nick could've phrased it better; but seeing how he didn't, I'm guessing the kids are gonna have to beg Dame Rekieta since daddy is a piece of shit.

What's most infuriatingly obtuse about this new cope is that Monty being able to just up and "withdraw" as Nick put it isn't even a thing in the first place, and instead Nick had control over whether Monty could ever use dismissal to avoid discovery, yet Nick chose to give Monty permission to dismiss at this late stage:

There having been a served answer making a unilateral dismissal impossible, if Nick was so supremely confident that the discovery materials he requested and Monty's dwindling funds would combine to ensure Nick's inevitable victory, then why did he voluntarily direct Randazza to cosign a stipulated dismissal that Monty was not entitled to?

The real tough guy move would have been to respectfully decline Monty's request for dismissal by mutual stipulation, thereby forcing Monty to attempt a motion begging the court to allow unilateral dismissal, then have Randazza fiercely oppose the motion on the grounds that the plaintiff having started a lawsuit he knew he couldn't afford to finish has forced the defendant to incur so many costs that it would be inequitable to deprive the defendant of the opportunity for vindication at trial and to allow the plaintiff the luxury of fleeing the very litigation that he brought upon himself, unless some manner of cost-shifting could be ordered to make up for it.

That golden opportunity for cost-shifting, and the possibility of ensuring that the dismissal is with prejudice, are both exactly the sorts of highly discretionary "terms and conditions as the court deems proper" that Rule 41 is built for, and could have resulted in a collectable money judgment against Monty to drive home the point about who really took the L. Nick was free to go down that road, but instead this weak little bitch pussied out with a stipulation because he wanted this case's costs, risk of loss, and potential discovery humiliations gone every bit as much as Monty did, if not more.

Never forget that because of how Rule 41 operates, Monty didn't "withdraw" as Nick put it. Rather, Nick settled.

Okay so potential MAJOR Revelation.
So you guys remember the time when Rekieta's Give Send Go was taken down (He was raising money for MontaGraph's Lawsuit)? Rekieta said that he didn't knew it was taken down and we here thought that he took it down out of shame for raising such little money. Well, it turns out, it was potentially criminal for him to have that thing up and running and Montagraph contacted the ATTORNEY GENERAL to get info on the legality of that Give Send Go.
He also alleges that Rekieta might have stolen funds from Vic's fundraiser, through Rekieta LLC.

The money went to an IOLTA under Ty Beard's firm's control. If Ty paid Nick for services out of that, it would have been at Vic's direction, or at least sign-offs.

The original goal was 100k, but they blew past that. The gfm said any unused moneys would go to charity, but given that Vic was out of pocket about $500k? $600k? And Ty apparently didn't do any make-goods for Vic, there was no money left.
