I'm actually with phil on this one, I'd love to see the restreamers go away, because we'd be one step closer to phil's streaming career finally collapsing. If the restreamers went away, no detractors would go to phil's actual channel instead where they're banned in the chat, everyone would just find something else to do. The only reason phil survived so long doing youtube is because of all the negative attention he receives. His channel should have died off in like 2015 but there's this massive ecosystem of trolls and white knights that keep him going.

I think he has a mail service in Florida that someone he knows has access to, IDK how summons works against a LLC, if this place is even incorporated, etc. Damages for DSP would be easy enough to find out as Raw Phil uses YT monetization and Alphabet already separates creators by Tax Identification Numbers for their 1099s, etc.

Would it even get to the point of arguing if Raw Phil and others are "transformative"? Wouldn't the numerous clips of Phil giving restreamers permission to restream him completely shut down any case he has?

It won't get to any point outside our autistic thought experiments because DSP will never file anything but bankruptcies or tax payment plans.

I am surprised at the level of uptake this lawsuit malarkey has here and on X. With respect for my fellow posters, taking this seriously is like getting an 8-year-old who says he’s going to be President a campaign manager. Phil’s helplessness and incompetence make him undertaking bespoke licensing agreements enforced by groundbreaking copyright litigation a fantasy. Reminders: Phil can’t load his laundry machine. Phil can’t save a penny.

The more interesting question is what he’s diverting from. Time will tell…

I don't know about that. Whenever I go to these restreams, it's always the same people in chat who must watch regularly. They'd be watching at Phil's channel while banned in his chat. Although, many of them are on alts already so *shrug*, the vortex is tiring.

Phil will never get it that so many of these loyal watchers would still be on his channel if he didn't treat everyone terribly.

If Phil actually had a case where he could get real money, I think he would. That isn't here, though. He has no claim to the tips that Tevin, PoP, etc... receive. The best he could do is a restreamer like Raw Phil, and there's not much there.

I view this like when Phil bitches about losing ad revenue on a video. I agree with him that it's bullshit, but it's for pocket change. It's just baby Phil on his soapbox pisses because it's PHIL'S MONEY.

At the end of the day, the fact remains that Phil is never going to spend the money and put in the effort to hire a lawyer and sue anyone. That has always been his position, he has said "I could easily sue detractor channels and win but I can't afford to, only rich people can afford justice" dozens of times. The only difference is he has changed up his tactics and is now making a pathetic attempt to essentially blackmail detractors into making a deal with him. This appeals to Phil because if it works he gets more money, he gets it right away, and he doesn't have to do anything or take the risk of losing a lawsuit. But the blackmail threat has no teeth because everyone knows he won't sue.

This is an interesting point, in that Phil has the right to give and revoke the rights for people to use his content and reupload it as they see fit, however just because he revokes it doesn't mean that people need to quit doing it, as his initial allowance gives a person defense against his copyright claims. If he took Raw Phil to court, he'd probably win, not sure how much he'd be getting out of him/her though. Everybody else is a loss cause since it's all transformative stuff.

The statements that will come back to bite Phil in his ass is his repeated assertion that the clips are taken out of context and edited to make him look bad and spread lies (or slander as Phil says) about him. That will be an absolute defense because Phil would have to admit everything detractors say about him is true and everything he says that gets clipped is true, meaning he legally can't use that excuse anymore and would basically have to admit to being addicted to DoorDash and WWEC who's constantly late on all his payments, or he'd double down on it all being lies to make him look bad which would result in losing the case and most likely having to pay a bunch of money for legal fees.

It's a win win no matter what in my opinion.

I’m not sure how he is nowadays, but Mitchell was among the best, if not the best, during the early 80s when games were hard as fuck and walkthroughs did not exist. He’s on a completely different level than DSP.

from my understanding (which isn't much) he would have a good case against rawphil, since a lot of raw's viewers openly state, they watch rawphil so piggy doesn't get the views. You probably can make a legal argument, that, even if rawphil himself doesn't express that, it is generally understood that way by the audience.

That being said, it would be catastrophic for Phil, if he did that and I think he knows that much.

I'm not sure, how to state this, without violating the rules of this fine webforum, but I don't think it takes much imagination to predict, what the more unhinged element of the detractors might be willing to do, if piggy actually started suing a bunch of detractors.
I'd expect even a bunch of outsiders smelling the blood in the water and coming in to fuck with him. It's generally socially acceptable to fuck with people who flag down channels or use copyright (even if they're correct in doing so).
So, you'd probably see a bunch of the more psychopathic/sadistic element of wings/cyraxx etc. trolls, becoming Phils newest biggest fans and try to do some real damage.

Why would you think that, if youtube doesn't shut it down your recourse is to take it to court, the cops aren't ticketing you for copyright on youtube or something, if he isn't going to get through DMCA he has no other option than to go to court and spin the wheel on litigation, the Sargon case took years and tons of money to get through, Phil or anyone who thinks that it would be a low cost slam dunk and a payout for Phil is dreaming.

There have been several instances of dents tipping Raw Phil by mistake, so maybe he sees that as money he is entitled to that he lost out on.
