what exactly is the point of a trial when the reason for deportation (being in the country without permission) is already established fact?
like, if ICE do a wrongful arrest, all it takes is showing your valid visa documents to the immigration judge at your deportation hearing and the whole case is immediately thrown out.
then again, if you have permission to be in the country then ICE will just check your ID, run it through immigration databases, and see it, so you're not getting arrested by them in the first place.

immigration proceedings aren't criminal cases. we're not talking about contested accusations that are difficult to prove or disprove, we're not talking about complex legal situations that require careful consideration by high courts, and we're not talking about severe punishments that require careful deliberation by juries. it's a really simple and straightforward question of "did we give you permission you to come here?" - if the answer is yes then you can stay, if the answer is no then you will leave.
