But we'll never know if he pays. Other clients will never know if he pays. There's no credibility at risk here. He can send her $10,000 tomorrow and we'll never know it. She can say it didn't arrive, or that it wasn't the right amount, or just never mention it at all and vanish. Or she can say that it did arrive when it didn't to keep the story going and not have to post the tape.

She can break the NDA anytime she wants for any reason she wants because it's a less-than-a-handshake-agreement-make-believe piece of paperwork, at best. If the tape is real, game theory tells you to just cut your losses.
The NDA is not some sort of oral agreement they went over the phone in 2 minutes. I am rather sure there is a written form somewhere - paper form or online.
He could literally go to court if she breaks it - he doesn't need to, though. Show her employers proof of the money transfer and then she would need to proof it didn't arrive. They have a contract of some sort.
In any case, it would be a lot of trouble for her and he would lose nothing other than paying what he owed anyway.

So how do you think DSP is going to write off the mystery girlfriend arc?

Breakup? Turned off by detractors? Hitachi wand malfunction? "I lost my house and had to move and now my soulmate won't live with me"?

No its not. The NDA becomes invalidated in the event of non-payment. Which is on the 12th of January.

It's not a legal document doooooooooooooooooooooooood. If you sign a contract that says you have to move to Pluto if you can't do a triple backflip, you aren't going to have to get on a rocketship in the event of failure.

Also if the video features her it's not revenge porn, it's just her porn

This is wrong unless she properly filed model agreements, and even if she did, it would make the idea of an NDA even more laughable because she would own the content outright.

wow a lot happened in a short amount of time. So the brownie story now is not true, because there is a mention in a video in one of his prestreams and its tottaly not paranoid to think that she went through all those hours of stream to make that up.

Either way the brownie story would just be a piece of solid evidence to make her story more likely. As someone said before the story went from 99% back to 95%. Some people having an autistic blowout reaction was funny to watch though.

@RandomAccount going to court is never an option for phil, for a plethora of reason. But the simple one she is in the netherlands.

Read "the oxford handbook of the economics of prostitution" it explains a lot about contracts better than anyone in this thread would be able to.

I'll tell you what, I'll be more amazed than someone watching the moon landing for the first time via a hologram in the fucking stone age if Phil manages to get a woman who looks/passes as the pictures he's already posted and actually checks out with all the details he's given so far. I'd rate Jesus resurrecting in the next 10 minutes as being more likely.

I did last time it was posted, it has 1 and half page on the subject of contracts, mentions NDAs zero-times and basically says "None of this shit is enforceable."

I am fairly sure that contracts only are non-legally binding if they in some way go against the basic law of the country/state.
NDA are actually legally binding. Whenever you get employed by a company that works with sensitive material you are forced to sign one to, for example, not make any information about your work public. If you do so, you will get sued. And this does not just apply to governmental jobs.

But im street smart not books smart (:_(
Pay the hoe or get yo shit kicked in.

The legal enforcability of the contract is a red herring, it's not important and likely to much of an investment to be worth pursuing. Only thing here that matters is the damage to either party's future credibility should they break it, Phil with his donors and MW with her Escort Network which will have serious consequences for their financial situation.

That's nonsense, though

"A non-disclosure agreement (NDA) [...] is a legal contract between at least two parties that outlines confidential material, knowledge, or information that the parties wish to share with one another for certain purposes, but wish to restrict access to or by third parties. It is a contract through which the parties agree not to disclose information covered by the agreement. An NDA creates a confidential relationship between the parties to protect any type of confidential and proprietary information or trade secrets. As such, an NDA protects non-public business information. Like all contracts, they cannot be enforced if the contracted activities are felonies."
Wiki is right here and confirms what I said above:
It's a legal contract UNLESS any of it goes against the law. No backflipping into outer space or something

Read the post above yours. We've already discussed NDAs like a thousand times.

Prostitution is illegal (and so is """escorting""" or any other euphemism that you want to use.)

Its called companionship which is perfectly legal even in the US he pays for companionship if sex comes into play its more a mutual agreement just like when you go on a date. Unless now people are gonna say that having sex with your date is illegal too lol
