In any cases that I'm aware of a win the owner had to make a case that the work in some way either damaged their brand or posed as canon material (Disney indirect sequels/ unauthorised star wars novels / the Chinese Harry potter official sequel).
Anything less and it's a case of fair usage and parody. Considering Sonichu is and electric hedgehog POKEMON you've got a very grey area.
They money involved getting a case heard simply isn't worth it to little guys.

I think it'd be easier to convince a judge that a full length reimagining of Sonichu negatively affects the value of the brand, than to explain the ironic nature of Sonichu parody fanart to the judge.

The derivative work doesn't need to generate a profit to impact the market. As I understand it, judges (not that a judge would ever see it, of course) side with the original creators pretty often.

And I think Chris would have a better case because he's a small time comic artist, trying to support himself with his patreon money.

Edit: Like, I think the big argument is whether or not fanart exploits Sonichu or instead brings new attention to Sonichu.

The anti-Chris argument in that case would be "my fan comic is ironic, people will want to read the original Sonichu to learn more." (ie it's not negatively affecting the market value of the original)

The pro-Chris argument is that Sonichu looks like crap, and redoing the Sonichu plot in a new comic is literally just lifting Chris' work, making it look pretty, and leaving the original comic in the dust. That would severely affect the market value.

Now, we all know that Sonichu is crap in any form and this isn't affecting the market value. But I think the pro-Chris argument is easier to persuade a normal, non-autistic judge of.

So shouldn't he be harping Brian or the Rosechu story since it's basically a retelling/adding shit in the Chris originally didn't bother to since he knew it was bad??? Usually for fan art you don't need permission or approval. Also, @Marvin, when's the last time Chris resubmitted his copyright for sonichu??? Wouldn't it expire or something if he neglects to do so, or is that just for a trademarks?

I'm not sure what you mean. Chris can like the story or dislike the story or either or, and he can still assert his privileges as the copyright holder.

You generally do. Publishing a derivative work without the original author's permission is copyright infringement, although in court, you can claim a fair use defense.

No, it doesn't expire. That's trademarks.

And technically, you don't even need to register a copyright to begin with. It's very helpful to do so, and it's highly recommended, but technically if you can prove you created the work before a given date (like if someone wrote a news article or some shit about you, that might suffice), then you don't need an official registration.

In the US, normal copyrights last for the author's lifespan, plus 70 years. (Thanks Walt Disney!)
