When I read the dismissal, I thought the judge was giving Russ too much narc fuel, seeming to take him seriously (as the law requires) by saying he’s “well-educated” and admitting his facial disability causes significant challenges for him-two things Russ wants everybody to know.

When considering a motion to dismiss, you have to consider the non-moving party's fact in the most favorable light, i.e. consider Russell's complaint(s) as favorably as possible. That's why the order describes Russell's alleged facts as if they are true and accurate. Also, just as an aside, Judge Pead likely didn't write this order; all of the federal judges I know have their law clerks write everything. That's why I think there's so much light sarcasm throughout the order, the clerk was having fun with it.
