Sounds like they're going in the absolute wrong direction on this one. Just randomly ranting while committing a crime, or resisting arrest, when someone is in a fucked up state and just raging, doesn't prove they had some racial motivation for it. If someone explicitly states a racial motivation for a crime before committing it, then commits it like they said they would, that's one thing. If they say a bunch of dumb shit while they're being arrested and acting like a COPS episode, that should really not mean shit unless it's relevant to the crime, like they actually admit to details of it.
Cops need thicker fucking skins. If the only thing the guy you were arresting did was say mean words, get the fuck over it, snowflake.
This is part of why I disagree with the very concept of "hate crimes."
