Rackets has done another video looking at a possible Mark Waid defense based on a 'Truth' argument and a small 'Justification' section at the end.
I can tell Nick loves making these videos, they always get a lot of engagement and views.

So Waid claims that Zack is a white supremacist and the truth is somehow a smoking gun for them? W/Zaid know Zack has bi-racial children, right?

No. Its basically that if Meyer was claiming that Waids defamation led to AP cancelling the contract then if Waid can prove his statements to be true then the statement is not defamatory and therefore could not have led to AP cancelling the contract.

However in the Plaintiffs complaint no claim is made of the defamation being the cause of AP cancelling the contract.

Additionally under Texas law the truth defence to a TI claim has in fact been ruled against at the Texas Supreme Court as recently as 2016. If Waid were to succeed with this defence under Texas law then Meyer will have strong grounds for an appeal.

If this is true the pro-Comicagate Youtubers (but not Meyer himself as it might fuck up his court case) should publicize the fuck out of this, maybe even try to interview this woman. It tears right through the "Mark Waid protects minorities" rhetoric.

If he has he shouldn't. It's much smarter for him not to say anything involving Waid, because that is discoverable evidence that could be used against him. Richard's lawyer is obviously smarter than Zaid by keeping himself and his client out of the spotlight.

Alternatively, has anyone considered that Zaid might be a smokescreen that will allow Zaids actual counsel to do her job out of the public eye? Zaid seems to be the type of high profile lawyer that takes the spotlight and helps to finance and publicize the case, while the actual counsel crafts a solid pleading and defensive strategy.

This is a very public case with two (somewhat) prominent public figures, and one side is clearly trying to create publicity. Waid's Texas lawyer is clearly a pro with no engagement, so she can leave the spergery to the Super Lawyer

It's not legally necessary to create publicity, is my point. Of course, that's not stopping them, is it.

Zaid based on the antics and sperging I've seen him do is an attention hogging shit that comes off like a more competent Landau given his history of claiming the credits of others and how he goes after kooks for most of his non-participation trophy big cases. He thinks the court of public opinions matters on a civil case, which it doesn't; only the judge or jury mean shit and he isn't likely to have them sympathetic to him.

I would not hire this creep as my counsel based solely on this, even if he gave me a discount.

Nick R had an interesting observation about why he assumed Zaid was no longer Waid’s Lawyer when the Texas lawyer filed her response. Zaid isn’t named or requested as Pro Hac Vice in the filing. Which is very unusual. The Texas Lawyer May simply be operating on the assumption that this is a referral and not a co-council situation. If so I can’t imagine her being pleased or supportive of Zaid’s online antics. I will not be surprised if or when the Texas Lawyer files a motion to withdraw due to being unable to control the client or Zaid. You have to expect the actual Texas Lawyer is probably telling him to settle quickly and quietly. Whereas Zaid is egging on the Anti Comicgate Crusade to the Clients ultimate detriment. You have to assume Zaid and the Texas Lawyer will quickly come into conflict.

It doesn't for winning the case.

It's great for raising money from suckers and rubes, though, to go straight into his pocket.

No, the closest Meyer has come to talking about the case is favouriting or 'heart-ing' some YouTube comments along the lines of 'Hey heard about the case, i hope you win, F* Mark Waid' on his videos. Everything so far is coming from either Waid or Zaid, Meyer has wisely taken the advice of his council to shut up about ongoing litigation.

I thought it would be interesting to have Zaid talk to Rackets, about whatever law topic he wanted for a video. Now all i want is for Meyer's lawyer to go on his show and talk about his reaction to Zaid's big fat mouth after winning the lawsuit :optimistic:

I never said it was. I merely stated that, if done correctly, it could be a good way of drumming up much needed financial support or publicity, basically the only reason Gloria Allred has a career. Whether Zaid can actually pull it off remains to be seen, though my guess is probably not.

Zaid's still his lawyer, he stated that he was Pro hac vice despite the motion to extend didn't list him as such. My guess is Waid's Texas lawyer is probably busy doing her research and crafting an appropriate response.

Nah! Avenatti will probably be disbarred in the Not to distant future. The state bar already has him on their shitlist regarding his old firms bankruptcy and the intermingling of client escrow accounts. He managed to questionably sidestep any personal responsibility in that through some clever incorporation games, but it put him on the radar. Now GE is accused and will likely be indicted for suborning perjury before Congress. And his political shield has evaporated as the Left blames him for losing the court for 20 years.

Whereas Zaid is just a grandstanding asshole. If the State Bar investigated or took action against grandstanding assholes simply for being grandstanding assholes, even New York would quickly run out of Lawyers.
