As a lawyer, Nick holds himself not just to standards of pure legality but ethics, and there's a general rule (8.4(c)) prohibiting dishonest or unethical behavior. I think it is clearly deceptive to donate to your own GFM to seed it, whether or not it is clearly prohibited.
I don't know whether Nick is basing his decision on something specific in the TOS or just his opinion that donating to a GFM he organizes would fall beneath his level of ethics.
