Even if that person is correct, it doesn't take into account the TI component of the lawsuit - which is where the major component of damages will come from. Truth is not a defence to TI. Nick and Ty have said this repeatedly.

I believe it varies by state. However, kickvic is willfully ignoring that defamation is only one part of the lawsuit. Even if they didn't have a defamation case at all - which they do - they could still sue and win for TI, because that doesn't care about truth. Because Texas.
Also the semantics are pointless, because in the end KV can't prove something that doesn't exist. Even if Monica, Marchi, and Funimation all managed to prove what they said were true, Ron's such a flaming idiot that he will fail and drag everyone else down with him.

I don't know about the rest of you, but I'm going to trust the successful lawyer working in his jurisdiction over a random person on Reddit. I think it bears stating and re-stating that everyone in this case, from Toye to Vic, is innocent until proven guilty. For the Kick Vic side to be guilty of defamation what they say must be false. However, to say that Vic needs to prove falsity of the statements assumes Vic's guilt, which doesn't seem like something the United States court system would tolerate.
Of course this is just speculation. Defamation in the US courts could actually be this kafkaesque guilty until proven innocent nightmare of a anti-justice system. The person above has numbers and quotes, while all I have is an appeal to authority and a statement that amounts to "it doesn't feeeeeeel right". I guess we'll know soon enough who has the burden of proof in this case.

I saw something about Jubyphonic and let's be honest, do you blame these people for not saying anything? They stand up for Vic actively or vocally and then they have to deal with all kinds of shit like 100s of idiots slandering them and a couple news articles lying about them. I wouldn't really speak about it either because I don't want to have to handle extra heat if I don't have to. I hate to be cruel but that's the reality. Now if I knew a lawfirm was going to be suing these idiots, you can bet your behind I'd be the first one to call them up and tell them everything they need to know. And that's the best part.
These people think all these people like them and are easy to push around, but I can imagine they hate them and only put up with them because $$$. Yeah, they're disposable, but now you lost a well known VA to push a product. Not that they're worth much value. For cons sure, but for dubs barely anyone gives a hoot. I can imagine a lot of them don't mind Vic as he seems like a fun guy to be around. Not someone you want at your house but keeps the industry entertaining (besides they probably never really see the guy anyways other than at cons). They think "C" is this one guy who cracked and turned on them, but in reality, nearly everybody turned on these guys.

Those VAs and Funi execs ain't got no one on their side as this mob doesn't care about you. Hell, nobody but the farms really care about you and they only do simply to laugh at you. These people only care about being "righteous" and "good" by slaying some "pedophile" because destroying people is always the right answer. Once this is over, those "friends" of yours will throw you into a garbage can just like the VAs no matter what outcome. And have your "friends" message me those emails on Twitter. I won't only redact all confidential info, but I will plast it on both KF and Twitter for all to see without saying who it's about and who it's from. Hell if you even manage to send me one of those emails, I will friend and retweet everything you say. And I'll have to absolutely humiliate myself on KF. Doesn't that sound nice? It won't happen 'cause you've got nothing.

Yeah, I think the VAs who haven't said squat are the ones most likely to come out unscathed, no matter who wins the trial in the end. Whereas Monica, the two Jamies, DC Douchebag, and the like are busy flapping their gums about what a cunt Vic supposedly is, sane people like Laura Bailey, Travis Willingham, Cherami Leigh, Kyle Hebert and Chuck Huber remain silent and are spared the wrath of both sides, keeping them firmly out of controversy and able to continue their roles without any bullshit to tear them out of it.

I wouldn't want Jubyphonic to speak up. She's too sweet/socially awkward to dive head first into this internet shitshow. Also it's in the best interest of all the VA's who are staying out to stay out. Some careers are coming to an end and a lot more roles are going to be available for the surviving VA's that haven't burnt bridges.
