Chris-Chan Arrested and in Jail, awaiting Hearing on Monday (28-Dec-2014)

A thought has just crossed my mind: should this go to trial, would the defense dig up the CWCki and try to argue insanity and incompetence on Chris's part as a result of over a half-decade's worth of cyberbullying?
Chris is not insane and that defense is hardly ever successful anyways. Maybe he could try blame his actions on emotional stress and tie the CWCKI that way, I guess? I'm not a lawyer but Rob Bell is and I don't believe he ever referenced the CWCKI when he represented Chris.

If he gets a public defender, the guy probably wouldn't care enough to look. I hear those folks are horribly overworked and probably wants the case over with. Chris is another brick in the wall to normal people.

Most Judges feel that way about most cases, so yes. The only exception will be if they feel super passionate about the disabled or want to be tough on crime.

Is getting institutionalized an option as well?
Technically, but not as a practical matter.
 
Whatever happens it won't be the big deal (on the long run), this is just some more foreshadowing, money and Barb will eventually say goodbye, take a guess what's going to be the saga's finale.

I'm curious. Can you arrange a visit with someone in jail if they don't know you? Would the guard say "Hey you got a visitor..."


If he does go away for a while, I'm sure he would be willing to talk to a fan from time to time...

Don't try to visit him unless you're already acquainted. If you must, send him a letter sometimes.
 
That's where you're wrong. As TV has taught me, this is going to be a mega-trial, like the finale of Seinfeld. All of the trolls and various players in Chris's life will testify against him, with moderately humorous results. It's going to be so nice to meet everybody in person!

For some reason, I just imagine it like the final moments of a Twilight Zone episode. Chris is sitting miserably in his cell, he looks out the window and sees Clyde Cash, who's laughing smugly as he walks arm and arm with PandaHalo, with their kid beside them. Chris just looks at this in silence, then begins to scream out "Damn you Clyde Cash! Damn yoooooooooooou!"

The other bans are irrelevant, unless they call the B-Manajerk to testify there's no way that'd be admissible. You're right, the assault is a big deal here, but we have to wait until we know the charges to see if he has any wiggle room. My point is more that the court system in that city/county, like any other modest American metro area, is already too busy with drunks, drug addicts, wifebeaters, you name it... Chris is a soft case. The judge wants it out of his/her courtroom, and the DA, even with the video, will look at that stuff and his rap sheet, let the new guy handle it and not worry about the outcome. I think he'll serve some time as part of a plea arrangement, but probably because he'll be unable to pay any fines if he hires an attorney and/or pays a bondsman. The course most likely to get him off, and if I can play amateur public defender for a moment, would be to not make bail and take it to jury. omit the atismu during jury selection and hope you get a sympathetic white knight on the jury that'll gum up the works. The judge will dismiss this case with whatever the jury first hands him, believe that. Guilty, not guilty, hung jury. If guilty, ask for time already served in holding. Gone, on to the next DUI.

This is a huge deal to us, but the judge deals with despicable people all the time, and Chris doesn't rate.
Most people in authority aren't very familiar with or understand Internet culture anyway.
 
In my opinion, I believe Chris will probably not get real jail time. He may get a few days to a week or so in jail or, he will probably just be sentenced to a mental hospital for a few weeks or so. Nothing longer than a year. I really hope he does get some real mental help this time and not just a slap on the wrist though. It may do him some good.

You don't get sentenced to a mental hospital for "a few weeks". Treatments can take years or forever. A Psychotic Cocktail like Chris' is far too ingrained for any sort of treatment imo. At best, he could be trained on how not to be an insufferable prick when amongst the other patients, if even that is possible. Chances are that even under those minimal expectations, he'll keep being a severe ass and he'll be spending a lot of time in a "time out" cell all by himself.

If Chris goes into the funny farm, he's not ever coming out. He's too permanently broken to exist in our world.
 
-The fact that he's getting video arraigned means he's probably up on state charges and not municipal charges. This means it's probably a more serious charge and could be a felony but is likely a high grade misdemeanor.

It a felony for spraying gas which depending on how it charged is either class 3 or 6. I generally agree however that the right thing for Chris to do here is the plead to common Assault take a maximum of a few months in Jail (if I was running this for the state I would think it time for a step up I would seek on a common 90-120 days Jail paticalurly since he got a break last time and the conduct was just so dangerous)

Also if there is a election for mode of Trial I would elect Judge Alone, I would NOT repet would NOT trust Chris with a Jury nor (unless I could find good Case law on subjective self-defense because of the long term trolling) put on the stand
 
Even though Chris would obviously get sent to a man's prison and not a woman's, it doesn't really matter... either way he'd be in for a good ass beating ;)

Chris in a woman's prison would be hilarious though. I get the mental image of him strolling up to some full-body-tattooed 230lbs-of-muscle woman who's in for punching her husband to death, and trying some kind of smooth-talkin' chivalrous line on her - and she just doesn't do anything because she's too confused to react.

You in VA? Out here in Missouri it would likely be charged as third degree which is an A misdemeanor, I'd have to look at the case law to see if they could boot strap it up to second degree which is a felony, but I doubt it.

In practice assault is usually dealt with on the municipal ordinance level here unless there's a deadly weapon or a hospital trip.

I don't think the police tapes shed any light on exactly how he was brought into custody, either. Assault on an officer, perhaps? Did he make it to his car?

Good thing you didn't read the whole thread, you'd swear we already knew the charges.

How can you say that when Chris has never received professional help before?

In the jail call the Police Member stated he was be held for spraying a gas, so under my read of the statue Chris would be Charged with common Assault and the Illegal Use of gas which is a felony separate from the assault charge.

The thing is the really bad part of it is that pepper spray was let fly for no reason in a packed store
