A couple things about this document are concerning, particularly with sharing content.

Content
The gamertags, gamerpics, screenshots, game clips, and other posts you make on Xbox can be a great way to show off what’s meaningful to you. We encourage all players to be themselves and show off what they like, what makes them laugh, or what makes them amazing. But this sharing can’t come at the expense of other players’ positive experiences.

Remember:

  • Use your skills and creativity to add informative, helpful, funny, or interesting content that contributes positively to our vibrant and diverse community
  • Content you post on Xbox needs to suit a wide audience
  • Context is important, and mature content that makes sense in a game might not be appropriate elsewhere on Xbox
  • Not everyone has the same likes or dislikes as you, so think twice about saying something hurtful about someone else’s content, playing style, or choices
Does this mean that recording footage of shooters is disallowed because of excessive violence or gore? Gears of War (a MS exclusive) has a lot of that; if they're taking this rule at face value, then you shouldn't share clips of that game without getting repercussions. Or games with political imagery like Call of Duty, Wolfenstein, GTA, etc. Slippery slope.

  • Try to circumvent regional content restrictions
So no changing your region to buy or download software only offered in select regions (Games with Gold is a prime example of that)? Consoles nowadays are region-free, so this is unnecessarily restrictive. Importing isn't cheap. Would they revoke access to those games if your region doesn't match the game's?

  • Manipulate game stats to increase or decrease your standing in a game
  • Use multiple profiles to unfairly manipulate your multiplayer rank
What about people that willingly want to "boost" to earn achievements, especially in a game with little population? XBL's Looking for Group feature even encourages that. This would be a big issue for most players.

Given how this is written, this goes against MS's sharing and community engagement if this gets enforced by the T. There's a lot of holes in this, not just with trash talk which is what people are mainly concerned about.

I kinda want someone to put in the effort and troll people exactly like that now.
 
I am of the opinion that Riot Games/League of Legends is still the most oppressive censor of gamer speech in a competitive environment. I'm not saying Blizzard isn't somewhat cucked, but it does depend on the game; Overwatch chat is super-patrolled but WoW is still pretty safe to be glib in and literally anything goes in Starcraft 2 and Heroes of the Storm team and general chats.

Riot though, holy shit. They went so far as to actually remove general chat and chat channels entirely from their client, unless you're friends with someone. They had a Tribunal system that gave players currency for helping skim and filter reports for harassing chat, and that failed. But within game people are still calling each other names, extreme and mild, and getting reported and suspended/banned for "toxicity" on the same level as ResetEra moderators. Some people play intentionally badly just to get other players mad and then report them.

Nintendo has shacked up with Tencent. Nothing is off the table and tencent's history of fucking with companies is legendary.

This is just Nintendo being late to the party as always. They'll announce global etiquette changes for developers and players, just give it time.

They already have but Nintendo has the more vanilla of players base is when you get to PSN or Xboner where you see the "go fuck yourself with a chainsaw" comments, also Steam but unless you do that crap in the forums they will not care (also they have a word filter that change insults to hearts)

One could argue that it's a valid strategy and valid method of climbing in ranked play: tilt the players on your side to get them banned and make room for you to move up in your division.

Also, if you are even remotely decent at the game it takes real effort to lose enough to remain in the iron or bronze leagues at the absolute bottom.
 
They spent the early years having the community with bar none the worst sportsmanship in a game that has been trying hard to be a esport. So you got trash talk, the equivilant of intentionally passing the ball to the other team to score a goal and a plethora of problems that cant be resolved by a referee on site.
 
But expressing anger as edgeless criticisms isn't really anger at all. It's just...advice.
