What harassment are they talking about? They opened themselves up for harassment the moment they decided to flap their gums and go public with their twitter spergs. They can't backpeddle now and say that providing proof will make them a target, they were already fucking targets. This is the goddamn internet. except that won't work. Ty could prove they made it public far easier than wiping his ass. the only way a judge agrees with that line of logic is if he's literally a zombie that just melted from sun exposure.
I did state it was public and prior I was implying that the harassment they did met where mostly asking questions and for evidence of the allegations. I wasn't implying that the protective service would indeed work in their case simply due to them claiming they've been harassed due to Vic and his 'fans.'

Unless they can actually provide some proof of the "harassment" they've been receiving (and Texas doesn't give a shit if you've been made fun of online), then it's not going to work. Asking inquiry questions is not harassment. Now...say if they were able to prove they received actual death threats and threats of bodily harm, that's a different story. But no gives enough of a fuck about them to actually threaten them. We're all just content with laughing at their lolcowism.

Mostly it's the Lawyer playing for time when the hour glass ran out in record time in this case. It's a beyond pathetic delaying tactic and shows that Casey is likely just taking the money to put his kids through whichever college they want.

Said Lawyer's also explained to them they're very fucked if it goes to deposition.

It honestly smells like a hail mary type play.

If they try to pull that, it's pretty simple. "OBJECTION! Defense had the opportunity to disclose this in discovery in response to the opening requests for production, in deposition, in responses to subpoenas #1-whatever, and didn't do so."

And it's stricken and they're not allowed to introduce it.

These requests for production are their opportunity to produce the evidence for their defamatory claims. If they "win" and don't do so, the result is all that's left in evidence is Vic's statement that these claims are false. They aren't allowed to introduce any evidence in support of them. They automatically lose and we might as well just save time and go straight to the damages phase to find out how big they lose.


If you actually have an argument, you cite case law to support it.

If you're rabbiting on about the "trial court's broad discretion" you're basically whining PLEEEEEZE PLEEEEEEZE JUDGE SAVE ME.

This bitch realizes he got a legal filing described in POUNDS, not pages, right? As in, a 20 POUND takedown and deposition request?

Edit: Oh shit, now I get it. They're claiming being sued is harassment and want the court to give them, effectively, a restraining order against Ty and BHBH?

Last time I saw something like this happen a buddy was in the hospital and his roommates were using his PC. IRC is a hell of a way to find out someone's in the ICU.

Why do I get the impression that they might be trying to gag the youtubers? I can't think of anything that Ty would do that would fit that description, and the entire KickVic side has been harping on "muh harassment" for literally the entire ordeal.

Can't gag the youtubers, however I bet they could make an argument that Ty needs to cut of all contact with Nick / other youtubers because "they're repeating what's going on in this trial and telling people the stupid shit we're doing is harassmentt!!!!1111"

Nick hasn't really seen it yet i dont think. He seems to have been really busy, and is late getting to the normal chat he does on Wednesdays. As for Manning yea, he's gone completely radio silent since getting extremely sick so keeping my fingers crossed.

Well if nothing else it shows that they're lawyer is competent enough to know that their plan of letting everything come out at court is idiotic. From everything that's come out, this seems like the best legal strategy for their lawyer to go with.

See, you know that, and I know that. The whole point of Discovery is this is where -all- the evidence is put on the table. The question is do the #KV supporters know that? Because from all indications places like PULL still want to act like they have some silver-bullet to win this despite all -physical- evidence pointing to the contrary.

I actually wouldn't be surprised to find out he unprotected so that he can get people tweeting at him "Your motion is full of soy and so are you", and then take those to go crying to the judge about being harassed, you have to stop that internet lawyer monster!

Not that I think that would work. This is 'Murica, after all, and Texas in particular. But I can see him being fool enough to try it.
 
Question on the protection motion because I'm not all that knowledgeable on the intricacies of the law: is it possible for BHBH to use their multiple past public statements about how they were eager for the trial so that everything would come to light to the public to argue against the protection??
