Nah. Nick and Ty have both said from the outset that they expected the other side to buy time. Given the extent of the information being requested, it's not even unreasonable for them to need more time.

Both legal teams are using strategies they believe will be most advantageous to their clients - and that's literally their job.
 
Like I said, I've no doubt the judge will grant them some delay time. It's a gimmie. Maybe a second time later on, if their lawyer writes up something truely exceptional. Either way: they're burning their timeouts early.

They need to. That's why Ty just dumped all this on them right at the outset, to put them immediately to the decision of either going in to deposition in 14 days and get fucking ass reamed on the conference table in BHBH, or have to file some delay and show up in court over it.

In an ordinary case, they'd have met and conferred prior to this and probably just put together a discovery plan, or at least waited until the answer was filed. In this case, Ty obviously just told them go fuck themselves (possibly in nicer language to opposing counsel but he is not going to go out of his way to make that guy's life nice because of his client) and if you don't like it you can take it to court.

So that's what they had to do.

The message in including discovery with the opening complaint was to let opposing counsel know Ty would be backing up the Pain Train, and the deposition subpoena complete with subpoena duces tecum "inadvertently" included is the Pain Train, it's here now, immediately, right after you got served.

They also have an idea from the subpoena they included that this is how things are going to be from now until this case is over. MoRon should look back nostalgically to having a peaceful life because that shit is over.

Casey Erick tried to pull a somewhat scummy trick by noticing Vic for deposition at the end of May (without noticing Ty which ironically is what Casey is now whining about), presumably so they could then immediately, the very same day, file a TCPA motion and get discovery stayed in the interim, so they'd have Vic's deposition but the plaintiffs wouldn't have MoRon's depositions.

So Ty turned around and noticed MoRon for depositions before that to avoid that situation. He paid them the same courtesy they paid him.

OUCH. And even after Ty has said multiple times that he's willing to play as nice or as dirty as the opposing side is. With this shot fired I get the feeling he's not gonna be willing to play nice any longer.

I've asked this already in the Weeb Wars general thread, but deliberately trying to circumvent someone's client-lawyer relationship by communicating with them directly instead of contacting their counsel is an ethics violation, right? Or does it make it acceptable that the communications was a legal document?

The reason for the rule is to prevent a lawyer from taking advantage of a represented client by getting them away from their legal counsel and interacting with them directly. That isn't really implicated by a deposition notice, and apparently, isn't actually against the rules in Texas. It's still a dick move because the client then needs to contact their own lawyer who then has slightly less time to respond.

Instead of whining about it, Ty basically just said fuck you, that's how we're playing now? Fine.

It also undercuts Casey's own whining that "he hit me back first!"

It's not like this came out of nowhere. The trick is scummy, but it's hardball, and actually pretty clever.

The concept is they cruise into the TCPA with Vic's deposition in hand, for whatever use it is, but the plaintiffs don't have anything from MoRon.

Imagine you're their lawyer and your clients are two absolute idiot blabbermouths who will nuke themselves the instant they open their dumb, lying mouths. What can you do about this? Keep them off the stand at all costs because you lose otherwise.

This is one way to do that.

The problem of course is they already have hundreds, maybe thousands of pages of them lying already.

He was given some of the worst clients imaginable, his opponent has money to be burned, money that will keep flowing in as events pass I'm sure, and he probably didn't even have time to comprehend wtf was going on. This guy is going to lose the case, bar the hand of God slapping Vic, and he knows it. He has to make the best out of a shitty hand, it just so happened to be a scummy move that pissed off BHBH.

Which is totally fine if they came with some legalese for "we are unable to provide this in the timeframe specified and need more time". Instead from reading the response it sounds much more like "we are not going to provide any of this ever and we resent you for asking".

I don't think anyone wants a kangaroo court for Ronica, Mariachi and Ruination, even if that's what they gave Vic. If they want more time, even if 2 weeks should be enough, then a judge would probably grant more time. Instead they are literally refusing to do any discovery at all!

We'll have to see how much of a valid strategy it is to toss, twist and turn at every time to make things go slower and abuse the system instead of playing nice. As I said before, it wouldn't surprise me that Ronica's counsel feels this is their only claim to victory at this point since Roy burned all avenues for defense. Still, they may have showed their hands too early for this to be even effective in the long run. Time will tell.

I think his best option would be to settle out of court - but you just know that that's not happening if Ty doesn't think the defense is being amicable (and they're definitely not, this early in the game, at that). Instead their counsel is only digging a deeper grave for Soye and Monica.

Remember that time when Soye said we're ready to go to court but then started stalling from the get-go? It's only going to get worse from here and if that's the defense's plan of action, they'll likely end up having to pay millions of dollars in damages plus face even further ridicule.

Something harsh enough that they feel the sting of their bad behavior, and have that bad behavior explained to them with in excruciating detail.

Sending the notice of deposition to Vic instead of sending it to Ty Beard was what made it especially scummy.

It isn't up to what anyone else but Vic wants and he's made it abundantly clear that he doesn't want to do this and he wants it settled so he can move on with his life and career. Every autist on the internet wants to turn someone else's life into another battle in the Culture War where complete and total destruction of the enemy is the only acceptable outcome. That's not an option for most people. They have families, careers, and lives that are being destroyed by this.

Litigation isn't fun. I've been sued for $1.5M in a frivolous, not by legal definition, suit that took years to settle. I'd go months not thinking about only to freeze up when the cold fear of having my life ruined hit me while I was doing dishes. I never realistically thought I would lose, but what if I did? My insurance wouldn't cover it all of it. I'd have to file for bankruptcy. It ruined the plaintiffs as well. The small amount of alleged damages they settled for, paid for by insurance, actually left them in the hole for tens of thousands of dollars due to lost wages. They won and still lost out because they allowed themselves to be taken by highest profile ambulance chaser in town.

Now if it was an autist like me in Vic's position I'd make it my life's mission to destroy these people. When we'd take contact in Iraq my desire was to never just kill the enemy. I wanted them wiped off the face of the Earth. I'd have called in fixed wing to drop a MOAB every time we took fire if I could have. It's a mentality that I have to keep in check because it's dangerous and unhealthy. This is fucking with people's lives. Most people have lives to live and things to lose.

Well what they were trying (supposedly) was to try to get Vic's deposition, then immediately the same day file a TCPA which puts a halt on all discovery for 90 days, which gives them some much needed time to formulate a gameplan with all the information while Ty is stuck only with what he already has.

Ty ain't dumb though so he's basically forcing them to burn through their time-outs in the first quarter of the game by pushing Monica and Ron's depositions so early.
 
Just FYI. I have been really Ill lately AND my goddamed computer blew up right before I was recently hospitalized (I'm still very much touch and go as far as my health). I am typing this out on an Android phone.

One thing that has crossed my mind is Ronica's lawyer stalling for time not to help his client but to gather as much of a bill as he possibly can in all this. Wouldn't be surprised he sees Roy for the moron he is and is fighting this case for the money and not because he thinks he can win.

I mean, iisn't that what you would do if Ron himself came to your doorstep with 400 defamatory tweets and the opponent had a public warchest of hundreds of thousands of dollars? Pretty easy money from a retard who thinks he can actually win and is willing to pay so he can virtue-signal his M'lady into an actual marriage... food for thought, guys.
