Like I said, I've no doubt the judge will grant them some delay time. It's a gimmie. Maybe a second time later on, if their lawyer writes up something truely exceptional. Either way: they're burning their timeouts early.
They need to. That's why Ty just dumped all this on them right at the outset, to put them immediately to the decision of either going in to deposition in 14 days and get fucking ass reamed on the conference table in BHBH, or have to file some delay and show up in court over it.
In an ordinary case, they'd have met and conferred prior to this and probably just put together a discovery plan, or at least waited until the answer was filed. In this case, Ty obviously just told them go fuck themselves (possibly in nicer language to opposing counsel but he is not going to go out of his way to make that guy's life nice because of his client) and if you don't like it you can take it to court.
So that's what they had to do.
The message in including discovery with the opening complaint was to let opposing counsel know Ty would be backing up the Pain Train, and the deposition subpoena complete with subpoena duces tecum "inadvertently" included is the Pain Train, it's here now, immediately, right after you got served.
They also have an idea from the subpoena they included that this is how things are going to be from now until this case is over. MoRon should look back nostalgically to having a peaceful life because that shit is over.
Nick just gave a very brief factual update about stuff we didn't know yet.
Casey Erick tried to pull a somewhat scummy trick by noticing Vic for deposition at the end of May (without noticing Ty which ironically is what Casey is now whining about), presumably so they could then immediately, the very same day, file a TCPA motion and get discovery stayed in the interim, so they'd have Vic's deposition but the plaintiffs wouldn't have MoRon's depositions.
So Ty turned around and noticed MoRon for depositions before that to avoid that situation. He paid them the same courtesy they paid him.
