It means that as long as there's enough in the initial pleadings to establish that she did wrong, she loses.

She would be absolutely insane to let that happen. Even if she has no money, she can still settle with the plaintiffs on some other terms. There is no requirement that the terms of settlement be the same for each defendant. That's why Nick keeps saying whoever settles first gets the best deal.

Which is why I think Funimation is the one who is settling first.

It can be heavily implied that they "fired" him though. From a sudden stop in a long-term business relationship to the public tweet claiming they wouldn't be working with him anymore.

Whether a "wrongful termination" case could be made here, in some similar shape or form, I won't try to argue because it's above me (although I'm sure there must be prior litigation concerning that). What is important right now though, is that for Lawsuit Round Number 1, it can be easily proven that Funimation did something wrong in the eyes of a reasonable person, because they took an action over something that (for all we know) was not actionable in any or all fairness.

It Ty is going to be able to make something stick under this argument, I don't know - but at the very least it will be a central point of the case in informing the judge and jury that not only the rabid conspirators were after nothing less than an innocent man's entire livelihood and life-long career and claim to fame, but also that this wasn't nearly enough and they kept the campaign going for months after he had lost his job - and even after they were noticed by Ty that they would be sued!

Employee or contractor, the argument is out there in the open to be made, and no one will fail to see a clear cause-and-effect here.

Correct. Fukunaga was the founder of Funimation. He is fond of Vic. It also helps to know that Fukunaga is a Conservative Christian Who is partners with ex politician Rick Santorum in another studio. Echo light Productions, which makes Christian movies and such. Fukunaga’s Uncle is or was an Executive at Toei, the Japanese Anime company that owns and produces Dragonball. Toei likes Vic. Toei especially likes Vic after Dragonball Broly rocketed to become the #2 most successful Japanese anime movie in North America. Only surpassed by “Pokémon, the Movie”. That “third party” that you mentioned as forcing Vic on Funimation was Toei.

Sony bought Funimation last year. They haven’t really been drawn into this beyond being a party to “the investigation” since Funimation’s HR department is and has been completely dysfunctional. Sony May have acted stupidly based on bad information, but they probably don’t hold much liability for this shit storm.

Sony seems like a huge multinational corporation on paper. But the truth is they are a dying shell of a company. They’ve fallen from the worlds leading consumer electronics company to a corporate zombie. The only thing keeping them afloat is the PlayStation. On there American studio side, Sony Entertainment, the best that can be said of them is “at least their not Paramount!”. They’ve scored a few successful movies in the past two years, largely on the back of charity from Disney in exchange for using a Spider-Man in the MCU. Sony has a lot of leverage over Funimation. They have zero leverage over Toei, who is a much bigger and healthier Japanese company at present. (And Who is partially owned by Bandai Namco, an absolute juggernaut in Japan.)

It's worse than that. If you do not respond to a civil complaint filed against you, the court will simply assume that you agree with the contents of the complaint (at least that's how it works in my jurisdiction).
It's why ignoring a lawsuit is probably the dumbest thing you can do.
 
Maybe I'm misremembering this or I've gotten it mixed up with something else, but before the announcement about the investigation saying that they were terminating Vic (while implying he had sexually harassed people) wasn't there an announcement about there being an investigation but the results being inconclusive?

I did a quick glance back through the first post in the main forum, but didn't see anything, but then again that's just a summary. Anyone else recall if that was the case or if I'm clearly just making shit up in my head?

Doing a bit of refresher and looking stuff up, it seems that during the dubbing of DBS: Broly, there was some push back to Vic playing as the voice of Broly, there was an investigation made into whatever accusations were made that were then found 'inconclusive' and Vic Mignogna was permitted to continue to voice the character for the duration.

"io9 reports that two individuals attached to the Dragon Ball Super: Broly film appraoched Funimation executives and requested Mignogna be removed from the project and a new voice actor found for Broly. This allegedly took place during the summer of 2018 following “improper conduct allegations” against Mignogna. "

Seems to be after the first investigation turned back null, the same actors pushed for a second investigation at the start of this year. Personally I wouldn't be surprised if Funimation/Sony HR knew the claims were bogus, however they likely figured if these people can't play nicely together (and that the exceptionals would likely keep throwing a tantrum), that it's easier to replace one VA opposed to multiple ones. I highly doubt they expected it to blow up to this extent.

Exactly, but I think it's less that she's just hoping Funimation saves her or that Vic runs dry suing the others and more likely real petrification about her current disposition. She's likely realizing like Ty and Nick have said: no one can really afford to go to court. No one's going to have her back. It's literally going to be up to her, her significant other, and her potential council. She's going to need to gather her own legal strategy, and I can almost guarantee whatever it is will be a drop in the bucket compared to whatever Ty & co. have likely already drawn up.

No. There's no penalty for dodging process other than that you eventually get served by some other means. Even if you go completely into hiding you can ultimately be served by archaic means like service by publication, which requires publishing in a newspaper of record, even though nobody reads newspapers any more.

It's also not contempt not to show up for a civil case. You simply default and automatically lose the case. It can be contempt if you refuse to show up for a subpoena, get a motion to compel and get ordered to testify, and blow that off, too. That can result in a civil bench warrant and charges of contempt.

Otherwise, though, you aren't punished for dodging service. You just look like a jerk.

I almost want to see them go to court, but considering it's best for BOTH parties to settle this out of court, I do hope at least one defendant decides to act rationally and talk to Vic. Too bad because MoRon act like they've got this in the bag and Marchi is scared to even answer the door. Funimation will probably settle this out of court first.
