At the very least, she's just giving Ty more ammo to shoot her with. At any point when her judgment or trustworthiness is called into question, Ty can immediately shoot "well members of the jury, can we really trust the judgment or statements of a person who acknowledged that she was being served on Twitter but still refused to call or respond to the urgent notes left at her door, hence making it more difficult for every single one of us who are here today in court?" How likely is this to have a positive effect for her? Not very much, I wager.

And that's a wee bit relevant considering everything related to her on this case concerns the validity of her judgment and her words, for all the reasons everyone here is already familiar with. This is not a speed ticket hearing, it's all about dumb shit she said and whether she has or lacks character to do all of the terrible things she's alleged of doing. She's just helping paint the picture that she doesn't in fact, have any character.

In the end, I guess the best way to put it is that there's no way it looks good on her and can only come back to hurt her to some extent.

I have a theory on Casey's strategy: he's trying to motivate a favorable settlement for MoRonica. Think of it from his perspective. With the facts and law he's got, it's likely he loses the case if it goes the whole way. So settlement is the rational option. With that decision made, his goal shifts to getting the best settlement possible. Normally, Casey would put forward the strongest case he can so the opposing party thinks "hmmm, there's a chance we lose if we go to trial so let's settle". But he can't do that here. His case is shit and he knows it.

So how does he create leverage for settlement negotiations? He makes the process as painful as possible for Vic.

In this light his filings and general strategy make sense.

• Putting PULL and tumblr references in his answer actually hurt his legal case. But it increases the damage to Vic's reputation (in theory).
• Running up billable hours by engaging in scheduling shenanigans makes things more financially painful for Vic.
• His presumed strategy of deposing Vic first and then getting the discovery stay with a TCPA motion gives his clients more ammo they can use to cause Vic further reputation pain.

Then during the TCPA deposition stay period, while his clients and allies continue dragging Vic through the mud, Casey approachs Ty and Vic with the old "you can make this all stop if you settle".

Or he's just exceptional.

In fact it may be rationally argued that except for quickly accepting service for his clients, every other thing he has done has multiplied the eventual cost of settlement for his retarded clients. My theory behind the shitty pleading is that he's trying to tank the case in a way that leaves Funimation jointly viable. It explains why he tried to throw Funimation under the bus, and it also explains why there was no specific denial of the claim that Ron was acting as an agent of Funimation. He has a weak case with clients who simply refuse to settle, so his only viable defense strategy is one of damage control. Clinging onto a co-defendant with deep pockets seems to be his play at the moment - the obvious flaw is that his clients are screwed if Funimation settles.

If Casey is, indeed, a plaintiff's attorney then that's an interesting point. Plaintiff's attorneys very often work on contingency, so he might not even be used to keeping an eye on the costs because his usual clients are people who stand to receive large awards if they win, not people who are paying their own legal costs and trying not to lose.

Look at this from Funi's point of view. They can settle and get out of this for roughly the cost of 10 years of Vics salary/work compensation. They already have that budgeted, and if they actually use him they cam amortize that over 10 years and not have to pay another actor.

Another way to think of it is "saying Sorry costs them nothing but whats already expected in their operations budget." So long as they seperate themselves from the idiot VA's. The VA's face exemplery damages. No way does funi want a piece of that.

The situation is probably too fucked up to trust them to live up to such an obligation, though. If Sony would intervene and give him an ironclad contract with some more functional branch of their corporate octopus, though, that might be worthwhile.

Probably depends on how much they offer in regards to their communications. If they’re smart they’ll give them anything that establishes liability for the other parties while getting assurance that they’re not getting pulled in again. Sony of America is a shitshow from top to bottom. The suits in Japan are manufacturing executives, not media. They had no idea what to do with a media company beyond hire every art and marketing clown pumped out of the University of California system. And we all know what kind of people those are. I've seen a lot of speculation on what BHBH may be willing to settle for but I haven't seen much cited in terms of how damages are calculated. Setting aside the specifics of what we may expect of Ty to ask for, what sort of limits are in place? Are there norms/limitations for these sorts of outcomes? How flexible are the possible outcomes? Just as an example Nick's friend Josh from the other night. The dude in the weird colorful quilt scrap cape, is a Personal Injury Attorney. He outright had to ask the others about whether or not Casey's response was normal or a good defense strategy because he doesn't do defense.

Funimation has the most incentive to settle and Funimation can offer Vic the most incentive to settle. Funimation can do the most to repair Vic's reputation and they would be the ones directly offering him work. All they have to do is write a check, publicly state that "bad actors" fed them misinformation, and proceed to give him a few sweet heart deals.

What does MoRon have to offer? Or Marchi? Or the Tuttle Group? Nothing but money (which can be taken by force in a judgement anyway). The Tuttle Group makes a perfect replacement money bag because they have nothing but money to offer. Funi can settle and leave all these clowns holding the bag. All they lose is a cuck and two rapidly aging VA's who are probably getting too expensive anyway.
