I assume this guy is coming in at the request of Casey, because he is more versed with Anti-Slapp. He will sit in and listen to Vic's depo. He will then advise Casey & Co. Weather or not he thinks they have a chance at winning a TCPA.

That's an interesting take. Casey would have to be planning to openly defy the judge, however. Is he exceptional enough to do so?

I firmly believe he will do so. That is unless they didn't just hire this dude to file the TCPA in some bald-faced attempted to subvert the agreement Casey made in open court. Either or really. We're getting a TCPA before MoRonica's depositions.

Right, and the transcript makes it clear that at that moment Ty was interjecting, because he was beginning to realize that the judge didn't want to have to rule on the confidentiality agreement. He wasn't interested in wasting time, and he just wanted to get to the bottom of it, so Ty interjected over Jim Bullock and told the judge exactly what they thought was going down. Was it imperfect? Sure. Is it a sticking point? Definitely not, especially in comparison to the shit Casey has pulled.

That'd be pretty stupid and borderline unethical to do. If he genuinely thinks this new guy is more skilled, he should have given a recommendation from the get-go instead of taking money from people he didn't think he could properly represent, given that the anti-slapp motion is kind of a given in defamation suits, as both Nick and Ty noted a long time ago.

I think it's really all they have at this point. Unless they have some big gotcha, which I really doubt.

Granted, at this point a TCPA is a very risky move. Especially since Casey is on the record stating that he won't file one. Moreover, if they DO file one, and it doesn't pass... Well they are pretty much done for. That would mean the court did indeed find the statements to be sufficiently defamatory. And the very same judge who came to that conclusion is also presiding over the case.

To make matters worse, if they lose the TCPA, I think they will be liable for Vic's fees. The only good a TCPA does them is the 90 day (?) stay on discovery, which they can use to play to the court of public opinion....they really want Vic's depo for that reason... also to supplement their TCPA filing (if they make one). That TCPA will wrap up the defamation... The TI however... it will be interesting to see how that plays out.

At the end of the day, lawyers serve their clients, they can tell their clients that something is a REALLY FUCKING BAD IDEA a thousand times, but if their client still insists on filing anti slapp, not much they can do other than exit the case entirely.

They're going to file a TCPA and when they lose that (or partly win and plaintiffs have to file an amended complaint), they're going to file an interlocutory appeal to a higher court and hope that gets delayed for a long time. Then they might even take that to the Texas Supreme Court because that's just the kind of shits they are.

Yup. Everything is being prepared for a flood of gay ops. The Soupalolyer squad was called in to try and energize KickVic and give them someone to point at in order to say "look, officially smart people say we're not stupid, so we can't be stupid." As stupid as it sounds, they brought the Soupalolyers on Twitter in specifically to counter Nick and his streams.

I'm calling it now. They're going to file a TCPA tonight. It's going to ENRAGE the Judge. They'll be called into court tomorrow or Friday -- because hey, they aren't doing depositions and the courtroom is now free, so why not -- and have to explain why they pulled their stunts with the TCPA and the bullshit discovery games that are still going on. He can't do anything about their TCPA thing, but I bet you he can bring down the hammer on them for the discovery games if he's in a bad mood. (Like if MoRonica's team broke a gentlemen's agreement with him NOT to do the TCPA thing.)

Isn't Texas one of those states where if one or more defendants can pay the whole judgement they are liable to and then must seek financial compensation from the other defendants? I swear Nick mentioned that very early on.
That's not a state thing. It's a type of liability. There's joint liability, several liability and joint & several liability. Joint is generally like you and your spouse get a loan. Your spouse dies. You still have to pay the loan back. Several would be each party is responsible for their own portion. Joint and Several would be each party is responsible for their portion as well as the unpaid portions of the others.

The "fun" of joint and several liability is you can go after any individual defendant for THE FULL AMOUNT no matter who actually did the specific thing that caused the liability. And then, as the prevailing party, you can just take your money and go.

The defendant who had to pay all this money then has to sue the other defendants for their share, while the plaintiff is free to walk away and go on a vacation to the Bahamas with their money.

This case is a niche case and the mainstream media will never care about it. Kickvic tried to drag the MSM into this, but all they can get are a few super lawyers that tweet all day.
