Why the GFM? All they had to do is talk about io9 and they'd have some dirt to bully Vic with. Its like these people want to live in shoe boxes and suck cocks for Big Macs and crack.

I'm only catching up with the stream now, but they tried to pin an Italian guy raised by a single mother and still very close to her as a woman hater? Weird decision. Not surprising Vic did well, he's charismatic and good with words.

Also his Star Trek series is a registered non-profit organization and CBS was on friendly terms with them iirc, so good luck finding dirt there. It would be silly to tag Specht in when she told i09 she had thought her relationship with Vic was loving and monogamous.

Given that their pinch hitter lawyer was a TCPA specialist, I'm guessing these were part of some attempt to set up a TCPA argument in the near future. Trying to tie him to Star Trek, a world famous property, and perhaps trying to point out that "only public figures could get nearly 6000 people to donate nearly a quarter million dollars" or somesuch.

It still seems odd for them to have spent so long on those things. This was their opportunity to ask Vic a ton of questions with potentially embarrassing answers.

Maybe they think they get a round 2.
Nah, they just spent thousands trying to get another quick gotcha while under the impression they could possibly perjur Vic with info about Nick even though Nick has never once not been up front :story: This is all shit Shane and the discord gang wanted asked

Shane and his discord harlem should really just knock it off with the Nick hateboner… It's tanking their already dying narrative.

Maybe super duper TCPA lawyer broke the news to them that the TCPA motion is unlikely to succeed so their only hope is somehow getting the GFM shut down, even though it's too late for that. They're going to file a TCPA, lose, and then maybe a set of interlocutory appeals that also will not succeed, and then it's on.

Their ability even to delay is limited, even if they had unlimited funds for just that, which they don't.

They should spend another $50k doing dumb shit that the shoe eating imbecile wants. Hey why take advice from a lawyer when you can pay to tell them to do dumb shit instead?

I feel for Casey. I'd have a hearty kek if after all is said and done he makes a guest appearance on Nick's show to dumpster his current clients for being the absolute worst he's ever had or will ever have. Actual criminals, unabashed degenerates, and the clinically insane would all make for better clients.

Casey better have gotten paid upfront.

I don't think he's allowed to do that.... Attorney-Client privilege and all.

Unfortunately that would be disbarrable.

Results from Nick's Twitter poll from yesterday:

817686

Looks like only 17% think that Ron (who couldn't wait to get into court) will show up at all.

I'm going to guess by the what Nick has said and done that they've tried to hammer in that Vic hates women or treats them like shit and that they may be trying to drag Nick into this as an agent of Vic.

Funimation would fight that tooth and nail I would think. I mean, if Nick is somehow an agent of Vic then making the case for Moron and Marchi as agents of Funimation just got a whole lot easier.

That would fall flat pretty easily. It's a fan project, and anyone can raise a ton of money on gofundme. Even that homeless guy raised over 100k after it went viral.

The only thing I can think of for asking about Star Trek is that there is/are someone(s) from that series that have accused Vic and they are the super secret accuser that will bolster one of soy/rials affirmative defense claims. However, without the transcript or video (that Nick hinted at last night might be available?) I have nothing.

Maybe they think they get a round 2.

Casey does. In fact he demanded it in his e-mail exchange with Ty regarding discovery. That's what all his whining about the things Ty had sent him was about. To set up for getting Vic back under oath.

I agree that the line of questioning regarding ST Continues and the GFM are trying to set some play up for the TCPA.

Yeah, I think they focused on the GFM and Star Trek series because it'll help prove Vic being a public figure and make that extra step for Ty to show malicious intent for the defamation part.
That's the only sensible reason I can think of.

"Vic is a public figure as proven by his popular >1m views star trek fan series AND that he has crowdfunded this lawsuit to the tune of $200,000 he is clearly a pubic figure"

To be honest I won't be surprised if they get public figure BUT then comes "Actual Malice" which I think can be shown fairly easily tbh.

Even a really good affirmative defense isn't going to knock out a prima facie case. Whether or not Vic is a public figure is essentially a factual issue that must be resolved by a jury.

As to that factual issue, the judge is certainly going to remember that he actually thought Ty was Vic the first time he met him. I would be amazed if anyone on the jury has any idea who he is or will buy an argument that a fan project is enough to make someone a public figure you can lie about with impunity.
