it's legal as long as there's no agreement otherwise, but it's very very uncommon to have a video public because normally(as in standard operating procedure) the parties agree to keep things private during this time.
It really didn't help that certain defendants were running their mouths off on Twitter for months about how they wanted all of it to be public.

They're not "public record" because they haven't been filed anywhere. Usually you only see whatever sections of transcript get filed. They're only public record when filed. Video depositions are often made part of the record in part. It's fairly uncommon for the entire documents to be filed.

So they aren't public record, but they aren't legally protected, either, and parties (or whoever obtains a copy) can do whatever they like with them. Mike Dunford has made the dumb, bordering on sovcit level argument that doing so violates the law and infringes copyright. While it is technically accurate that the fixed copy of something like a videotaped deposition or a transcript is copyrighted, with the court reporter or other contractor who created it owning the copyright, the actual status of it as part of a legal case and its use in commenting on that case makes a very strong fair use case even for distributing an unaltered copy of it in its entirety.

The purpose for which it is used, and for which court reporters are paid, is use as an official copy in court, so any transformation which renders it useless for this purpose means the court reporter can still charge for it. This factor, whether the copy can substitute for the original and thereby impact its market value, is the single most important factor in a fair use analysis. The amount of transformation in some mathematical terms is not the issue, but whether the transformation effectively makes it something different, and specifically, something different that isn't a market substitute.

So, for instance, indelibly watermarking a transcript or video with something like "UNOFFICIAL" would probably suffice.

Needless to say, making a livestream of the deposition video that is even longer than the original video and comments extensively on it would not even conceivably fail to be fair use, something even a deliberately obtuse motherfucker like Dunford knows, unless his make-believe brain damage has turned into actual brain damage.

You are mistaken. Depositions are the property of the litigants and both sides may do with them as they wish transcripts and video/audio, baring a so common it’s almost pro forma rule 11 confidentiality agreement to only publicly release those portions of the deposition submitted into evidence. We don’t see many depositions because they are generally held as confidential under agreement between the parties. There is typically no downside and much benefit to all litigants in agreeing to this. That is MoRonica’s stupidity. Why would you fight a confidentiality agreement?
 
It surprises me that the defense counsel didn't extend the agreement to include the depo recordings themselves. They had to have known that Nick would show them (and make money out of laughing at the defendants).
Correction - it would surprise me if the defense attorneys were literally anyone but this collection of speds.
They were banking on Vic folding. "Lets see him squirm and panic from these allegations! Surely he'll drop the suit from embarrassment when we further defame him!"
They didn't expect he'd do reasonably well during deposition and he did start getting annoyed towards the final video.
If they could grill him for another 2 to 3 hours they may have broken him but they apparently ran out of questions and some were repeats anyway.

While what you are saying is correct the language may require a bit of fine tuning. The phrase “Implied Consent” typically has a very robust legal doctrine already attached to it. It’s the doctrine that allows you to render aid or life saving measures to an individual who is incapacitated and unable to grant “informed consent”. It’s what allows you to start CPR on someone or transport and treat a badly injured person. Implied Consent kicks in to assume the reasonable actor would not wish to be allowed to die, and to protect those who take lifesaving action. The key point being the individual is at the time incapable of expressing consent through incapacitation. What you are describing might be better thought of as a “passive consent” or “non verbal consent”.

I THINK it's because Nick has the actual videos of the deposition, not a recording of the live stream and is not distributing the live stream itself.

It's legal hair splitting, but I think Ty likely gave all of the deposition to Nick after lemoine released his edited (without both parties consent) transcript with highlighting. Something along the lines of 'if you want to play this game I'll just show the whole damn thing'.
I think it is best to remember what Ty has said, i will treat you that same way you treat me. (Paraphrased of course) Casey chopped and released information from the depo, time to open the floodgates. I hope we see scorched earth from this suit.
