I went back through the affidavits to find how many of them were first-person accounts of harassment by Vic - so not counting accounts of "I heard about/saw Vic bothering someone else." I found three. So much for the hundreds of women.

While a sophomore in high school and in a school play, Vic-senpai noticed me.
In summer of 1989, unvited me to his house to see Christian video but instead
tried to seduce me. After many rejections he became hostile. I left. I felt
scared when seeing him afterwards.

297    Affidavit of Kara Edwards

At Animazement in 2008, we had separate hotel rooms with a communal door
5 them. One night Vic gave me a long hug, then we went to separate rooms.
Vic knocked on door and called me; "nobody has to know." I went into bathroom,
literally shaking. At ShadoCon 2010, he invited me to his room to catch up.
He petted me and whispered in my ear and would not let me leave (No mention of
if/how she left this situation.) Another night he asked to come inside my room.
I rejected him. He lied about incident in the i09 article.

345    Affidavit of Kelly Loftus

At Kawaii Kon in 2014, I got something autographed by Vic for a friend. We
also took a photo together during which Vic was very handsy. We took another
photo during wich Vick gave me an unwanted kiss on the cheek.

Both the affidavits of Neysha Perry and Emmett Plant claim Vic did the hair-pull-whisper thing to a Star Trek cosplayer at a con in 2013, but there is no account from the cosplayer herself.

How can he claim to know why Vic goes to smaller conventions? Is he a mind reader? Maybe Vic is friends with the owner, or wants to meet fans who can't afford the big shows, or he just wants to have an excuse to visit a particular city. Sheehan's whole thing is garbage.

I don't know how happy a Judge is going to be with someone using a legal document to insult opposing council, while they're protected from defametory lawsuits, it's still something a judge can hold against you on a personal level which wont be good for any motion you bring. Generally judges are pretty big sticklers for professional decorum.

I was gonna crosspost from the doucette thread about the lolyer spreadsheet earlier but got distracted. Holy shit, they're using the 500 page TCPA motion to lob childish insults at opposing counsel, I think the weeb wars really may be a lolsuit to surpass madcucks. I'm sure the judge is gonna love it.

They've set themselves the retarded goal of winning the case at the TCPA motion, so they're trying to argue their whole case in the TCPA motion. Ironically doing so has nearly guaranteed that their TCPA motion will be dismissed.

I really hope that BHBH gives Nick an extra bomb or two to drop this evening. I would imagine that they're a little pissed off at this, if for no other reason than this motion is a fucking disgrace to their profession, so I could see Ty responding in kind.

Correct me if im wrong, but wasnt filing a TCPA for MoRon kinda a bad idea, especially when it was done at the last possible chance? And now Judge Chupp does not only have to deal with the idiocy of the TCPA, but its actually over 500 pages long? Ooh nelly every time i think this lawsuit might be toning down just a bit it finds a new gear to kick in and just goes full throttle

We’re dealing with people who don’t know how the internet works. And this judge and a jury don’t know how Kiwi Farms operates. Of course the horror stories are what’s gonna happen. Maybe one of the Nock deposition things is to get Farms bashing on record.

So much for there being a shadow master, I guess.

In regards to the TCPA, they use a picture that the girl in it said was cool with it and told everybody using her to pound sand. And that it was found that that picture was used to plant phony evidence. Has that shit been put on record yet?

And of those we have one that has been widely debunked, one that is a "kiss on the cheek" and one that at best would be a matter for trial as Ms. Edwards says in her afidavit that Vic himself denies that the events described ever happened. Why the Fuck is any of this in a TCPA filing?

As I'm going through this I am also trying to work something out. Please those more knowledgeable help me out. But everything in this is blind blanket attacks on Vic. Nothing in it seemingly is directed to any of the Causes of Action or the claims against the defendants. And this is where I am having trouble with the "joint filing" by both defendants. At every turn under deposition, when asked why he made the public claims he did Toye answered "I don't know" and "I can't remember". with regard to 400+ specific statements. At that point none of this should be admissible in his defense. He is the Defendant. Vic is the Plaintiff. The case is about Mr. Toye's words. Which he cannot explain or remember. It does not matter what internet rabbit hole Casey and Lemonhead have darted down to find some internet mean girls willing to slag somebody. The Defendant has already disavowed any influence by them. "I don't recall". How can these be used to defend Ron's Right of Free Speech, when he has no memory of them under oath?

how can this filing be separated between the two defendants Monica Rial and Ronald Toye? It seems to be getting into a real problematic area, doesn't it?
