Fair use is determined by a court, it's a defense. Youtube continues to operate because they give rights holders overreaching protection so that they don't get dragged into another lawsuit like they did with Viacom.

All those people you mention produce wildly different videos. Equating what Nick does which is primarily read legal documents to what TFS does which is primarily using anime footage shows that you yourself don't know what fair use is or covers.

TFS does more transformatively than react channels... yet as h3h3 demonstrated, react channels are transformative legally.

it doesn't take a rocket scientist to figure out from there that TFS is completely safe legally and the only reason they'd lose is that TOEI has deep enough pockets to flagarantly fuck them over with a super expensive lawsuit.

Judges in Texas are elected officials and under the Texas Constitution just short of them being homosexual or pedo it's nigh of no to removing them until election time.

Meanwhile as a taste of the Texas judicial system this is a county prosecutor's actual personal license plate just outside of Dallas

That liscense plate helps bolster my confidence that the TCPA will be defeated. I just don't want to get over confident.

Reaction channels can actively provide commentary and criticism to the work they comment on. But even then what H3H3 did was that their reaction channel was fair use in a court of a law. TFS has yet to demonstrate this because again, fair use is a legal defense. TFS has been hit with copyright claims and for one reason or another, they get their video back. Youtube makes no distinction between a party simply changing their mind or actively realizing that the video was fair use. So I hardly see that as evidence as such.

Explaining how TFS is safe must be as hard as rocket science cause even with the factors linked to you, you refuse to explain how they would turn out favorably for TFS.

If you want to argue that Toei has deep enough pockets to bleed TFS dry that's a separate argument altogether.

The product in question is DBZA? Dragonball Z ABRIDGED! No it is NOT Transformatine. Taking someone elses work and editing it down to condense it is not sufficiently transformative to be sufficient for Fair Use as a Defense. It isn't Parody or Satire. It isn't critique, commentary or educational purposes. It's a great example of what would likely fail the Fair Use Test. It's using the originals art to tell the originals story just pared down for time. But do go and believe what you will. We wouldn't want to shake your world views too much or accidentally tell you about Santa Claus or the Easter Bunny.

Let me go over it again. You asked specifically to demonstrate that TFS is in fact using fair use correctly. I did, citing that they do more than h3h3 did and they were deemed to be a fair use channel, which naturally sets a precedent that a court will definitely consider when making a judgement (assuming its brought up. It is entirely possible for TFS to become retarded and not cite it).

All you are doing at this point is flailing and screaming that people are wrong. stop it. it's shitting the forum up with dumb shit.
