TBH I don't have an answer to that at all. Either way, it was definitely sloppy or negligent work by Ty, considering he didn't *need* the affidavits. He also very easily could have, and should have, had the 3 parties notarize their affidavits on their own, even if he or others at BHBH helped draft the affidavits.
He was negligent because he is too smart. It happens all the time. Not wise, just smart.
He knew that in this case the two parties who might get hurt were either a notary or a client. So he didn't expect the defendants to complain about it at all.
What is the point of notarization here? Only that there was a guarantee that it was this person who signed it. That his identity is verified. And at this stage the procedure does not really require it. Specifically, this form of confirmation.
Moreover, it is obvious that Vic and Chuck and Chris will be summoned to court for cross-examination in the future.
