I don't know what the appeals process looks like, but evidentiary defects can be corrected in some cases. Like, if it's a matter of taking the tweet and showing what referred to it, we likely have the archives that prove it.

Twitter in a courtroom before full discovery seems absurd. It is forcing the Plaintiff to present and argue his full case without benefit of discovery, cross examination, and in most cases full context. Is Defamation no longer a law? It’s something I always dislike about Anti-SLAPP laws.
 
If what Chupp said, that like is not enough, this whole case is fucked tbh, since Ty barely brought forth any kind of context.

Oh well, to bad about this whole thing, just to bad about the smugness coming out then.

Apparently Monica is out on TI.

This is highly appealable. Slatosch claims in his affidavit that he had a conversation with Monica aboutVic's presence at KamehaCon, and Ron was there. He even says he could hear her and Ron talking in the background and agreeing. When Chris brought Vic back, Monica followed through on her threat to have other voice actors cancel, which they did. Keep in mind that the Judge has to put all this in writing, and if he's being truthful about reading the affidavits and considering them in his decision-making,verbal rulings have no real say until it's in writing. At the very least, appeals are an option.

This case is exposing a glaring weakness in the current day legal system. Basically social media has circumvented a lot of the protections the courts levied in the era before the internet was so permeated in society.

While the Judge may not think some things are relevant, in terms of the definition of law, those laws weren't written/amended with modern society's approach in mind. Thus, we're seeing it's dichotomy in action.
 
I get that not providing the context of the tweers was bad and dumb. However, I still have questions.

1) Marchi said vic assaulted her. The fact that she said that isnt in dispute, and isn't hyperbole. So how can defamation be off the table?

2) Didnt she keep claiming to have funimations confidential investigation details? That implies funi was talking to her about vic. Isnt that enough for a prima facie case for conspiracy?

3) Even lawtwitter was saying a while back that pleadings are counted as evidence, right? Since pleadings can be ammended at any time, shouldnt the discord stuff have been permissable?


IANAL and all that, but some of this sure looks reversible.

Just curious, wouldn't Jamie have the possibility to get roped back in if Soye actually releases documents from the Discovery request if it makes it that far?
