People seem to be acting like the defamation and conspiracy got through, but Chupp just hasn't passed his decision yet. So it could still go either way. I think it really goes to show how bad Ty fucked things up, when Marchi, and TI are completely dismissed outright, while Chupp is still considering the others.

I’ll be honest, after reflection I’m not entirely surprised. With the evidence available the only thing that was going to be viable is defamation. I think @mindlessobserver is correct that after discovery is performed there will be much more concrete evidence on the other claims. As long as Funimation and Ron stay in play I think discovery will help shine a light on the rest.

Ty didn't even fuck up TI. That's just a mistake by the judge. That was a thoroughly well pled cause of action in every respect. Unless the transcript comes out and he was slobbering and drooling all over himself I fail to see how that's a mistake by Ty.

The only thing he clearly fucked up was the affidavits thing which the judge couldn't have cared less about. Sometimes things just don't go your way.

Soooo, basically, the KickVic people are treating today like it's a full victory and the StandWithVic people are treating today like it's a full failure.

Based on what I've been reading here, neither are true.

expectations were that Marchi would probably slide on most charges (she was generally the least involved), while Moronica/Funi would get slapped with TI and, if lucky, defamation and conspiracy. I think most people would have considered that a “win”.

The biggest fear here is that Chupp’s attitude towards the case makes future prospects look dimmer.

Tbh if KV walks out Scot free they'll have nothing to whine about. People will stop caring and stop interacting. It was like what happened with Heidi and Jared. People mobbed her at first but once she felt she was winning people stopped engaging with her like they did before. Most importantly, they exposed themselves and will likely not be able to find employment beyond Funi and RT and friends.


But if they lose they can constantly bring it up and stir up drama since there was no resolution. They can tease their truth and fabricated evidence. They can rub salt into their own wounds. People will pity them and they'll get pity jobs because that's current year agenda.

If Vic loses, he can move on. He won't be the same but he'll move on.

If they lost this case, Sony was going to clean house. Sabat, Shimmel and Rial would be out, we would be talking about Phase 2 right now.

Instead, they got some claims dismissed, at a cost. Funimation's streaming service lost subscribers as a result. Gen - Funimation's owner - has been looking to cash out the rest of his stake and likely will not get top dollar in an eventual sale. The VAs had some embarrassing information come out.

I'm sure everyone is going to celebrate and hope things blow over. Putting aside an appeal for a minute, are they really getting away unscathed? There's a lot of dirt about these people out there now. Even if the SJWs are going to try and pave it over, it's not going to be a smooth surface.
