I guess the honorable Lemoine, survivor of the West Nile has the last cough-riddled laugh, because invariably this means he's going to get paid when they take Vic to the cleaners on costs, and the indiegogo will help to fill that hole in his lung.

He can finally claim his first win too.

So, despite all this raging at Ty, did he actually screw something up or is it more the judge sided with SJWs?
Little from Column A and a little from Column B, but it's not so much he sides with the SJWs as made some very questionable calls and instead of treating the hearing as a hearing for the TCPA he instead handled it like it was a trial. As for Ty it seems like he just couldn't muster the words to explain the entire process and how they worked through DMs, Discords, etc. to the judge.

Yep, I was getting worried there for a hot second that Funi would manage to get away. The fact they didn't is a win imo. That is where the money is anyway, and the juiciest evidence...and Sabat.
It's not yet a win. Having some of the causes dismissed from the bench indicates that they were outright nonsense, but most of the time the court will make a decision after the hearing. So it's neither a win nor a loss on that element yet.
People seem to be acting like the defamation and conspiracy got through, but Chupp just hasn't passed his decision yet. So it could still go either way. I think it really goes to show how bad Ty fucked things up, when Marchi, and TI are completely dismissed outright, while Chupp is still considering the others.
Ty completely fucked things up. Any of y'all idiots that thought that Ty was some sort of master genius? Take a fucking seat, you were fucking told.

It's almost like they don't know what site they're on. We laugh at all the spergs - whether they're tranny, straight-pride, nigger, non-nigger, chink, street-shitter, (((them))) etc.

lol, the ISWV niggas are hilarious. We'd be laughing at the Kickvic side if the tables were turned.
What! kiwifarms is not Pro or anti anything.

Color me shocked, almost like there is a A guideline above the reply box which states so. :story:

Nick left the courtroom angrily because he saw the future of his superchats.

Jokes aside, Chupp threw out the more hopeful claims (albeit arbitrarily and with my full belief that there will be appeals).

Defamation and Civil Conspiracy are probably the more lucrative ways to attain a win, especially given that Discovery now has to be done regarding them. They are the two things that implicate Funimation and Sabat.

IMO, pursuing Marchi was a lost cause entirely and I think the majority of people who cared enough about this shit (and/or the leaks) have already unsubscribed from Funimation or will in the near future if their unsubscribe feature has returned from its "mysterious" disappearance. Everyone else doesn't care about Vic or the leaks. I think that Funimation falling into hot water with Toei is enough for them, even if the Sabat and other Funi casting couch allegations go nowhere.

Like others have mentioned, the TI dismissal is the most surprising result out of the whole hearing. I was going to say that Toye's meddling with Kamehacon was fairly one-to-one with what happened in Meyer vs. Waid, but Simeti's huge rant bolstered Meyer's case so much that I can't say that lol. Even so, the case for TI should have been a lock and I can't imagine Chupp's reasoning for its dismissal. Ty mentioned that they were going to appeal and I hope BHBH chooses to go with a more concise approach. Trim the massive fat from that 1200 page document.

We're only hearing laymen opinions at the moment though. I hope Nick isn't too butthurt to give a fair analysis of what went down whenever he does decide to cover it. Also, I'm interested in how the Gofundme donations are going to go because of this, and right in the face of the big giveaway Rackets is planning.

I doubt that Nick will ascend to lolcowdom anytime soon. He has his moments where his emotions charge his presentation, but so far, he hasnt done or said anything exceptional, and throughout this case, he's generally had a level head when it comes to his analysis and commentary.
Hasn't Nick had to play tard wrangler on more than one occasion?
Vic is just one case to him - one that he probably has devoted a little too much time (and personal investment) to, but he has the entire American legal system to dig through to find something else to talk about.

Stupid question time: if later discovery bears out the TI charges, could they be reinstated?
It can always be appealed. I still don't understand why people think Vic lost today. The judge was doing what judges do. I've sat in on quite a few cases to know that a judge can and most likely will interpret the case as he or she sees fit. The thing about this case is the defense really took advantage of a weakness and exploited it. But now Ty knows what to do and what not to do for next time. Just be patient folks the hot takes are amazing, but it isn't conducive for a mentally stable individual. Just breathe take a walk or something. There is still going to be a season 3 of weeb wars: The second wind.

Hard to do when the evidence for the TI is thrown out though.

Let's be real.

If they lost this case, Sony was going to clean house. Sabat, Shimmel and Rial would be out, we would be talking about Phase 2 right now.

Instead, they got some claims dismissed, at a cost. Funimation's streaming service lost subscribers as a result. Gen - Funimation's owner - has been looking to cash out the rest of his stake and likely will not get top dollar in an eventual sale. The VAs had some embarrassing information come out.

I'm sure everyone is going to celebrate and hope things blow over. Putting aside an appeal for a minute, are they really getting away unscathed? There's a lot of dirt about these people out there now. Even if the SJWs are going to try and pave it over, it's not going to be a smooth surface.

How many hours would it approximately take plaintiff to explain the context of this whole mess to the judge (who apparently didn't bother to read anything himself)?

I'm interested in the court transcripts and Nick's take on this, but I think Ty's fuckup is what ultimately doomed them.

If this is the true cause you have to wonder why they weren't more cutthroat about it. Ty mentioned on a stream that lawyers can get perfectionist with their documents but shouldn't he be able to account for that behavior by instating a hard deadline of two days before?

While the iron is hot, Nick should reach out to High T Greg and they should stream together. I'm sure they'd be able to get a few hate views and superchats.
