Registered just to post this: This judge is going to get fucking bent over and cream filled if this goes to an appeals court. If even half of what was said on that gator stream actually happened it's abundantly clear that he had no idea how to handle a TCPA hearing, had no idea what the facts of the case were, was making decisions about submissions made by Ty that may or may not even be legal, and probably popped a boner looking at Jamie Marchi. Ty's fuckup makes little difference to most of this. The judge handled the entire thing insanely improperly, demanded a level of evidence that was not supposed to be required, threw out evidence without striking it officially, and generally acted the fool. Just listen to the stream once it's archived and think about what some of that would sound like to an appeals court.
This isn't over by a long shot. I wouldn't even be surprised if Marchi is back in the case somehow later due to just how badly this judge may have fucked this up. I'm thinking Ty actually might have lucked out here honestly.

They were never dismissed. They were just ignored. Neither did he say the Affidavits were wrong because of the notary situation.
 
Besides, that was Round one. They'll be other bouts. Even if Vic loses (Which I hope never happens), he'll be fine. It's going to be a while, but he'll be okay. Eventually. And besides, Funimation got two black eyes and Papa Toei is looking at this and Sabat is getting looked at. Not to mention, Monica's reputation is trashed. We didn't get first place, but the consolation prize is looking good right now.

Unless he actually threw out the declarations supporting it, it sounds like a reckless, half-assed decision during the hearing which will reflect badly on it if there is an appeal.
I imagine that’s the one thing guaranteed to get appealed. The guy running the con has said they did it and provided communication showing as such. The fact that he was invited back under different terms after things were laid bare to Slatosh should be irrelevant to the fact that TI occurred in the first place.
 
I think the person I'm most sad for in all of this is Chuck Huber. He suicided his career to help a friend out only to have some one boomer up his affadavit and then get it tossed in the trash by the judge within seconds. We can sit here and be outraged at kickvic ruining a mans career but some Chuck put his on the line and trusted Ty not to fuck it up.
I love how so important this day was for most people who had been watching this since the beginning of this year, this day was going to be so fascinating on how it would have turned out in the favor against the kickvic movement but alas for the judge, it was just a Friday.

The TI was dismissed based on the fact that Ty couldn't provide Chupp a dollar amount that Vic suffered as damages from the breach of the KamehaCon contract. Literally had nothing to do with anything else.

I keep hearing stuff about how Ty messed up. On the other hand, from what I'm seeing, Ty came prepared to provide the exact level of evidence that would be expected at TCPA. This on top of Chupp missing or ignoring existing evidence like Vic's testimony regarding the values. I think Ty did nothing wrong here. Thoughts?
Chupp had some strange rulings, but Ty also flubbed some arguments.

Several times, the singly palm was his favorite.

So apparently he wanted something more than the tweets on jaime, said "dismissed" and that was it? He just abruptly moved on like they said on stream?
It was pretty abrupt. He wanted specific things, Ty didn't have those things, he dismissed it outright.

It's impossible to show how much Vic suffered from his KamehaCon cancellation, and re-invite. It's impossible to show the dollar amount that was brought in or lost, and that's what Chupp was demanding.

He didn't care about any other convention, he apparently focused on KamehaCon
Wait, they didn't have a tight estimate? I understand Chupp wanting to focus on KamehaCon as it's the biggest one in the case with the easiest to prove for TI. From there they can branch of and explain their methods of financial calculations for the other cons.
Saying it's impossible is a dumb idea in court. How could the judge rule on reimbursing financial amounts fairly without even having an idea on what to rule?
 
The affidavit can be used at a later date and time in the trial. This isn't the only time it will be used, furthermore Chuck can be subpoenaed and say the same thing in court. There's hope yet for Chuck's testimony to live on, it's already wrecked havoc on Funi and Sabat's lives as is.



Which means Chupp has bigger fish to fucking fry and not some bullshit that doesn't mean jack shit in the long run.
That's at least the silver lining of this case should the worst come. Even if Vic gets nothing, at least Funimation took a blow over those audio clips and the affidavits.

My guess is that Ty didn't have it because that isn't required for a prima facie showing.

I could've sworn we were laughing at the prospect of KickVic and other SJWs doing exactly that not so long ago. "They'll say he was a white male republican so obviously he would rule in favor of Vic." Don't go acting like some of you aren't doing exactly that after mocking the cows for it.

I don't really care for his decision today, but IANAL and it's not the end of the world (or case) either.
