There's a specific rule allowing the defendants to appeal immediately.

"APPEAL FROM INTERLOCUTORY ORDER. (a) A person may appeal from an interlocutory order of a district court, county court at law, statutory probate court, or county court that. . .denies a motion to dismiss filed under Section 27.003" Tex. Civ. Prac. & Rem. § 51.014(12).

It's the plaintiff who can't appeal automatically.

If the defendants are unhappy with the denial of the TCPA as to the defamation counts, they can appeal immediately.
God if thats part of the law thats insane, that inherently fucks with hte purpose of the law.

Yep and of course they did it. Ronica has been trying to drag this thing out as long as possible plus maybe he will change his mind in their favor and throw the entire thing out. Honestly more time helps out both sides just as much as the other they all have ducks that are far from in a straight row at the moment.

Wasn't there some inverse extreme where degenerates like Jimmy Saville could silence people? I hate these anti-SLAPP laws but the fear of some nutter abusing it to silence people seems to have ruined it.

The concept (quickly dismiss frivolous lawsuits, allow meritorious lawsuits through) is sound, but the application is fucked.

Part of the purpose of Anti-Slapp laws is to lower the cost & time of litigation in such cases when someone tries to scare you into compliance w/ a lawsuit

Including an automatic appeal means that appeals can and will happen and extend the time and cost of litigation.

This is mitigated somewhat because the appeals are supposed to be expedited but man it just seems like a way to have a LOT of lawsuits clogging up the appeals system.
 
What is the justification for waiting until after the other causes of action have been resolved before allowing appeal? Would seem to me (not anywhere close to a law expert) that stuff like this would be foundational to a lawsuit and leaving half of the foundation unfinished until after the house is built just seems illogical. Im sure there has to be some precedent or principle that justify this, just not sure what that would even look like.

So it sounds like a possiblity that there could be a motion to reconsider on the TI stuff for Monica and Ron, and by extension Funimation. I don't believe Marchi is going to be brought back until the appeals, if all the charges are out. But who knows.

All we can say is that the next up to 30 days is going to be quite interesting to watch. Make sure to invest in Conagra or General Mills.

In my opinion she just shouldn't of been included in the first place. Yes she said some bad shit on twitter but really the hair pulling thing nobody actually gives a fuck about that KV loves to pretend it matters but it doesn't. She's just a THOT I'm glad isn't included anymore so she can go THOT in peace now.

It depends on Chupp's finalized order. Then I guess it's a motion to reconsider if Ty isn't satisfied with Chupp's decision.

If the case is entirely thrown out, Ty can immediately appeal. If Chupp allows some causes through, but throws out the other, the defendants can immediately appeal while Vic has to wait until the trial concludes (in whatever fashion).
