Also the judge shut down the defense lawyers after ruling in their favor before they'd even made their full arguments, so if he reverses himself without having considered what they WOULD have said, now he's prejudiced them. The way he bungled this entire hearing means everyone involved has reversible error of some sort if he rules against them in any way.

I think Nick meant that the judge can make a bench ruling (e.g. Marchi removed on all counts), but in his written ruling basically go "lol no u" and stick her with defamation, for example. Will it happen? Probably not. But can it happen?
