Alright, so my best guess on new development right now is:

1) It’s something involving Chupp
- hard to imagine what this might be, especially considering it would be something already known to the parties (or at least defendants?)
- a recusal or something similar doesn’t seem like something we’d mysteriously know like a week in advance, unless I’m horribly misunderstanding the process.
- Maybe a reconsideration of something at the hearing, but again, not sure how anyone would have advanced notice before it’s filed.

2) It’s something involving testimony/evidence on front of the court
- seems possible someone recanted, or admissibility of some particular piece of information is going to be called into question
- this one seems most likely to me, but Nick has been talking about it if it’s a mostly done deal, whatever it is, so I would have to wonder how one would feel confident any particular evidence would for sure be thrown out, etc...

General notes (from memory, pls no bully):
- Defendants (for sure) know
- directly involves case
- strange enough that Nick doesn’t know what it means at this stage
- Nick wanted to hold off on reading the TCPA because this apparently could either effect that, or at the very least, affect the assessment of it

Did Marchi make an oops? Did Sam misrepresent something to the court? I noticed last night that Nick was giving far less praise to Sam when he was talking about the article. Im willing to bet its something to do with that tweet they were arguing about in the hearing

On what Nick said my though is right now that Chupp reconsidered some of his decisions.
The only issue I have with that is that Nick mentioned that it was possible to do that but would be unusual. Why tease how wierd and unexpected it is when youve already mentioned it

I'll be sleeping when you guys found out wtf Nick was talking about. I guess I'll have to watch the stream before coming here or reading twitter (well, any time not spent there is a positive for my mental health, tbh).

If they win TCPA, which i remind you is less than a months time, not only is it over, but they get atty fees, which means they got to spend nothing and its just over.

There's no rational reason to settle prior to the TCPA decision.
A couple of options.

1. Sony and Toei may have set a hard deadline "to clean this mess up."

2. Gen Fukunaga's share of Funimation is worth 7 million dollars. Right now Funimation is developing a reputation for crappy customer service and shady business practices. This lawsuit has probably brought a lot of unwanted attention to Funimation and Sony might be wondering if they bought a lemon of a company. It would be something discussed in negotiations.

So, yes, Funimation might save tens of thousands of dollars only for Fukunaga to lose millions.

Depends on how bad the bleeding is over there.
 
Ok, now I will be far out there, but will speculate since Nick gave us a scolding I will give one more guess.

Contracts? Since TOEI met with Crunchyroll we havent heard anything there, maybe Nick gotten some info?

I know this is way out there, but, eh, my last guess before the evening.
I actually think it is this. I think okatron5000 is explicitly removed from all further ventures, unless Sony approves.

A corporate restructuring behind iron clad NDAs might be a move Sony is making to mitigate any further lawsuits. It would be super low key and only insiders would really know the full context. It would also involve Sabat/iago making him a easier target for Ty. This might explain why Ty is "dealing" with this "mystery" right now. If it is shown that Funimation is distancing themselves from sabat for any of the rumors, then it only helps Vic.

I think it's gonna be a nothingburger.
I don't really feel like whatever it is will be substantial enough to do anything if we haven't seen one side or the other go full chimp.

We'll see.
I think it will be around the same value as Sabat's casting couch. The other side will unanimously declare it a lie. We and most rational observers will suspect it has a good chance of being true.

In the end I don't expect any sacred ointment moments, but more fuel to burn on the austism powered trash fire.

Edit: well looks like the frogs are gay and I was way more :optimistic: about what was going to happen today.

Well, in the least it kind of confirms that Chupp just wants this out of his hands as fast as possible.

Also, I'm sure judges get threats all the time. Why would these alleged threats have any bearing on what he should be doing as a judge?

If they work it out in Mediation it will work out for Chupp, I think he knows he screwed up, and probably doesn't want anymore of his rulings overturned. If he was going to dismiss the defamation he could just do it now and get it out of his court, but he must know it will be appealed and most likely he will be overturned.

I know it probably wasn't Vic supporters but Chupp is pretty dense if he couldn't even manage to go through evidence that was provided to him and instead waving off those involved in a case to go sit in the time out corner and come to an agreement.

So of course he'll assume who did it instead of actually researching who made the claims because he's allergic to doing his fucking job.
