On what Nick said my though is right now that Chupp reconsidered some of his decisions.Alright, so my best guess on new development right now is:
1) It’s something involving Chupp
- hard to imagine what this might be, especially considering it would be something already known to the parties (or at least defendants?)
- a recusal or something similar doesn’t seem like something we’d mysteriously know like a week in advance, unless I’m horribly misunderstanding the process.
- Maybe a reconsideration of something at the hearing, but again, not sure how anyone would have advanced notice before it’s filed.
2) It’s something involving testimony/evidence on front of the court
- seems possible someone recanted, or admissibility of some particular piece of information is going to be called into question
- this one seems most likely to me, but Nick has been talking about it if it’s a mostly done deal, whatever it is, so I would have to wonder how one would feel confident any particular evidence would for sure be thrown out, etc...
General notes (from memory, pls no bully):
- Defendants (for sure) know
- directly involves case
- strange enough that Nick doesn’t know what it means at this stage
- Nick wanted to hold off on reading the TCPA because this apparently could either effect that, or at the very least, affect the assessment of it

A couple of options.If they win TCPA, which i remind you is less than a months time, not only is it over, but they get atty fees, which means they got to spend nothing and its just over.
There's no rational reason to settle prior to the TCPA decision.
