I'd say the judge has two slightly different choices

  • Dismiss all cases and get successfully appealed.
  • Have Vic fans REEEEEEE at him for months

  • Dismiss almost nothing and bring Marchi back in and get unsuccessfully appealed.
  • Have KV REEEEEEE at him for years and Dallas news run hit pieces. Meet the next Kavanaugh!!!!
Chupp ran unopposed in the last two elections. Unlikely another Republican might run against him in the primary, but I don't think they could leverage the bad press.

I don't think appellate judges are elected. As you go up you more and more get appointed based on your record and reputation as a judge among other things. So if he plans to never go up the ranks he may weigh the press more. If he plans to go up the ranks, he probably has enough election security to protect his record.

I kinda wonder how exactly he thinks this is going to fuck Ty. It's fucking mediation; unless you're being a colossal jackass or completely insane during it, the worst case is usually you're pretty much exactly where you started.

And Ty is literally asking "I want my client's reputation restored and some money for his trouble given all the evidence we have against you should we get through this".

To my understanding, albeit much less formally, opposing counsel has to now argue against the evidence that they have that their case is running on fumes.

They have to argue that Monica wasn't lying when she said Vic nearly sexually assaulted her despite her story changing three times (two times in the case itself, the most recent time being her saying in effect that she wasn't assaulted) and Dahlin's affidavit. They have to argue that Ron was within his right to tortiously interfere with Vic's KC contract (good luck). They have to spin them saying, in recorded form, that Vic was going to have criminal charges pressed against him when no such charges materialized. Hopefully, BHBH'll shove the inconsistencies of the affidavits in their faces: Kara's documented behavior with Vic surrounding the alleged pursuit, the innumerable internal and external inconsistencies between Hunt, Falba, and Prager, the complete impossibility of McConnell's allegation, Specht's utter uselessness at everything except dredging up dirty laundry for the sake of people who allegedly put her in harm's way for years...

Ty made a fumble, in some respects, but the field wasn't level, anyways. Still, for the time being, this is the present venue of the game. Hopefully, he'll make up the disadvantage quickly and forcefully.
 
For the purposes of the TCPA, until the actual order is written, nothing is final. You can even be brought back into the case because the judge forgot to write the order in time, even if he dismissed everything on the bench. Hence, until the written order goes out, it's the same as if nothing was decided.

I don't believe there is a case directly on point. The main case for the dismissal by "operation of law" involved the hearing and the written order dismissing the case both being untimely. I do not believe a case has been squarely presented with a judge shooting from the hip and dismissing (a TCPA case) from the bench.

I've shared the details of this case, and let me tell you Mr. Rekeita and Mr.Beard are the laughingstocks of of several law offices across the country.
I'm certain that sharing the information entirely based on what KV tells you would make anyone laugh, doesn't really reflect reality however. Also would it kill this person to get Nick's name right, they're literally responding to him with his name right there. It takes five seconds to double check you've written everything correctly before hitting tweet yet these people still don't bother.

I'm not saying for sure you're wrong, but what basis do you have for believing this particular thing? I'm not so sure that it's the case, but maybe you've got a good reason to say this. I could be completely wrong on this, but to me it seems that a ruling from the bench is good enough, but if the judge failed to rule on everything else in time, you're still on the hook for that stuff.

The parties may have more informations from Chupp than we do.

They are. Trial court judges (like Chupp) are elected for four years, while appellate judges (like the ones who will overrule Chupp) are elected for six years. However, since judges pretty often end their terms by dying, many judges are originally appointed by the governor (in Chupp's case Rick Perry) and then subsequently stand for election (as has Chupp successfully).

I just saw bits of it but I think Chupp is pissed off about the whole goddamn ISWV vs KV thing. I don't think we'll be seeing Ty appear on the show at all just to avoid anything with setting Chupp off, not because he needs to focus on work. This deserves a medal to the most sweet goddamn justice as going around harassing people doesn't just let you off the lawsuit then.

I'm not a law expert but from what I understand, this is basically Chupp saying to get your asses together and act like adults and settle this out now or I'm going to make the decision nobody likes. Chupp could honestly just throw the TCPA out altogether and move on to the next phase just to keep this going forward. This is great for Kiwis, but kind of bad for everyone else. Tonight probably will be another good stream. If there was any time to settle, that'd certainly be the time, but we all know nobody is going to settle. And we're probably going to experience the greatest shitstorm in Weeb history. I'm gonna need a lot of popcorn.
