Another thing to remember is the public figure ruling is also back in play. They could easily overrule Chupp on that. For one thing, it is a matter of law, and for another, Chupp's reasoning lacked any foundation. I think that at the very least, if they remand, it will be with a mandate to develop the record to establish this issue that Chupp just fecklessly made up an answer to.
 
Previous forecasts were based on the assumption that Judge Chupp is a reasonable guy who will approach the case with the attention it deserves, instead of half-assing it as if it was a Subway sandwich. Let's not make that mistake again.
It was an easy mistake to make.

Chupp scheduled things quickly. At first glance, it was efficiency. Now we know he wants to get this shit over with as fast as possible.

Chupp doesn't make rulings directly ("You're not going to file TCPA right after you depose the plaintiff, riiiiight?"). At first we just thought he was doing dad mode and letting the attorney sort out their own mess, trying to be hands off as possible. Now we know he doesn't want to actually do work.

And so on.
 
Next KickVic narrative is to go on about how the appeal hasn't even been filed yet and then when it is to say the appeal's invalid because it's early and Vic has automatically lost.
Ultimately, none of that will matter if any of the defendants get dragged back into the thick of things and THEN have to go through an actual trial should any of the charges go through. KV's premature victory lap will just end up being an example of why you should always listen out for the fat lady before claiming victory.

In very slight defense of Douchette, he did predict all causes dismissed on TCPA. He must feel very smart right now.
To be pedantic, he actually predicted all causes would be laughed out of court. He was right on most but not defamation which he said would be super laughed out of court, but they weren't until later.

Besides that, if you flip a coin and i say it will 100% land on heads and it does land on heads, it doesn't mean it was actually 100% chance.
 
I'm mildly curious if Ty knew that Chupp was a fucktwat and opted to slyly get it dismissed and handed up to more competent judges... either way, I hope we have a Kiwi in TX that can get us the docs without going all "I'm HeRe In PuBlIc WiTh My GuNz REEEE"

True, but it would put Chupp under more scrutiny to not "yeah, fuck all this shit" again. Afaik, he can get in deep shit if he gets it passed back down and does the same thing, esp given that an appeal court handing it back is them essentially saying "you fucked up, try again"

Cant quite comment on if there would be some sort of punishment if the decision has to be appealed again and once again they find Chupp fucked up, but it definitely wouldnt look good.

Kind of becoming a fan of Judge Chupp, in the way you love the detractors who force you to sharpen your arguments.

He's a basic bitch of the Judge world. Probably has never seen a case like this, reverts to instinct, makes statue-be-damned kinds of decisions that leave a lot of questions unanswered. Like, there's no way to guess what the appeals court will decide because we don't know exactly what Chupp allowed in the record.

The real world is messy like this. Feels like we're seeing the default response to a defamation / TI suit and maybe this can be used to inform subsequent ones.
 
With Vic appealing here are a couple ways it could go.
The Right Way.
1. Procedures - this is prima faecie not perponderance of the evidence - Writ of mandamus 1 right there.
2. Ignoring evidence - another writ right there easy, Chupp gets sanctioned himself.
3. asking for more/exceeding the standard of TCPA - writ, overturned decision
4. T.I - writ, Ron loses his real estate license, damages aren't big for Vic but to Ron this is career ending.Ron is now out of work - No bank/real estate agency will touch that radioactive heap of human slag.
5. Defamation - that one goes through on all - Jamie gets off rather light but still throws a tantrum;firing Sam,appealing and losing. Another Writ...yay!
6. Conspiracy - All major players get tagged on this,Funi gets a call from Toei;bye bye DBZ it's going to CR, writ for chupp, Jamie wriggles loose but doesn't come out stainless.
7. Malice- Jamie gets the worst of it here - has to pony up,post retraction statement,non disparaging agreement in place.

Any other causes are overturned on Chupp. Chupp walks away with at least 5-6 writs, any cases that come before Chupp are pretty much sent up to appeals/review before judgement is final. Any confidence in Tarrant County system rates as a 0. Chupp steps down as a judge requiring a special election due to how badly he fucked the case up. Any judge elected has to start in appeals/review hell before confidence begins to be re-established.

The Wrong way -
Appeals upholds Chupp's decision, Bond is wasted,Vic shells out big bucks,Marchie and co. laugh all the way to the bank, confidence in #MeToo soars,numerous other people get tagged and clog the court system for at least a century. SJWs claim the victory and any speech is no longer "free" because "muh fee fees were hurt!"

Waaayyy out in left field - Some of the charges are upheld,some get tossed,case tossed back to Chupp - Chupp refuses/recuses himself- new judge takes the reins.Jury awards quad damages to Vic, KV throws a massive chimp out party. Ron reverts back and ends up in prison for battery,assault,domestic violence - get pink sock'd by some prison bull named Tyrone;Ron then marries his prison bull. Monica and Jamie wind up working small hentai roles. Both move to Vegas to be corner lizards.Sabbat has to sell off Okatron 5k - Funi out of business,CR not wanting to be within 500 miles of Sabbat. Schemmel is disgraced,recast, and takes the easy way out - no amount of Kaioken is going to save him.

I thought he was just wanting to just get the liquor because he's dealing with a bunch of idiots and dead trees. Was I wrong?
 
I've been looking around and it seems like a lot of the ISWV crowd are making the same mistake, acting as if Vic has already won just by going ahead with the appeal. The chimpout that ensues should the case get thrown out a second time will be spectacular.
It is literally a win win for us.

Vic wins all appeals = mountain of salt
Vic loses all appeals = mountain of salt.
Vic wins some appeals = smaller mountain of salt.
