Starting to believe Texas is just as fucked over by the American left as other states after reading about the #savejames trial. I keep hoping for the best when it comes to the appeal judges, though. I mean, Chupp's republican.

Conservatism is a joke. They have failed to conserve anything. Leftists want to shove a 3 foot dildo up your ass as fast as they can. Conservatives, instead of outright opposing it, will simply drag the process out over several decades.

It's the GFM, man. If they can get something to spin as proof that Vic, Ty and Nick filed the suit frivolously, they can ask the court to award sanctions to whatever level the court determines is a deterent to future frivolous suits. They've been after that WARCHEST since day one.

This was my thought, too. Lemonparty clearly wants to bleed Vic dry with sanctions. Nick pointed out yesterday a case involving a huge restaurant chain (potentially worth billions?) who got sanctions on the order of a few hundred thousand dollars. Getting a judge to sanction Vic for a similar amount won't be easy.

but if it does and chupp actually tried to force Ty to violate it.... well can Ty refuse and force the issue into a higher court somehow? I get the feeling if Chupp's behavior was exposed to a higher court he'd be very... 'disliked' fast.

Hopefully we can get a law-kiwi for a better explanation. But my plain-ass reading of it is: Not EVERYTHING he's asking for would violate privilege, but SOME of it does. So Ty can resist it on those grounds, because it's not his job to go "Well, A for effort, but this is blatantly improper. Let me help you fix that and concede the things I can."

Ty has no impetus to help his opponent here, and it would probably be improper/sanctionable if he DID put any effort into helping harm his own client. It's over-broad, and frankly baffling why someone would wait until a dismissal to request new evidence. If you want to accuse Vic of something, get your OWN damned lawsuit. That would be the proper time to subpoena new information.

But hey. Go easy on me. Not a lawyer.

Monica, Ron, Jamie and Funimation might not realize it, but them winning this lawsuit will come with a hefty cost. You can summarize their position, not just in imagery but in effect, with a single Yugioh card.

Not to mention WHY he wants/needs it. No case left, so it can't be probative to the case. At least not until/unless the appeal successfully goes through.

My theory is: Lemwah thought the judge handed him a blank check (and I don't blame him for thinking that), so he's trying a hail-mary to embarrass Vic, Ty, and possibly Nick.

Actually not, because it explicitly doesn't ask for communications between Ty and Vic, but between other people (including declarants in the case) about Vic. Any such communications unless Ty has known them since before litigation were for the purpose of creating work-product for litigation purposes which is not discoverable.

Based on transcripts, Chupp clearly saw that whatever decision he would make would get appealed by whoever got assblasted by it. He's stuck with this case, and frankly, the fuckwit deserves it.

I watched Rekieta’s stream this morning in bits and pieces, and here are some very interesting parts regarding Vic and the appeals:

• Nick says that the notice of appeal is due on 10/24 and implies it’s coming either today or tomorrow.
• It will be a short letter; further documents will be fleshed out in the future.
• Lemoine’s laughable letter states that he requests a hearing to serve but not fill billing records and insists on a 2-hour evidentiary hearing despite not speaking to Supreme Court.
• Nick says that they want a hearing to avoid objections, which is stupid because objections can be made at a hearing and even on paper.
• Also, Chupp gave them what they wanted, so why would they want a hearing?
• They don’t want the public to see their billing invoices. Nick theorizes (and I feel the same on this) that Ron may not have been honest about those legal fees at the deposition.
• Long story short, Lemoine’s letter is exactly what we all thought it was: a desperate attempt to cover their tracks and waste more time and the plaintiff’s money.
• Nick reveals that Vic’s appeal court will take place at Fort Worth - Court of Appeals of Texas, 2nd District, Fort Worth. Bryce King, Camisha L. Simmons and David Van Leeuwen will be the three judges.
• More interesting is what happened near the end during the super-chat regarding Michelle Specht. Nick says that Specht is not exactly innocent herself, her preying on his Christian beliefs may be act to “hide her demons”, and hints that her relationship may have ended earlier because she was SO not a “random thot”.

I was just asking if he could be reported for letting lemoine get away with all this bullshit but punishing Ty for something that essentially is meaningless and not even illegal/violation of protocol.
