I lean towards the idea that the appeals court will just say "do this again. Correctly this time." Chupp made such a mess that unraveling it would be madness.

They can't do that. The time for doing it is over. If they send it back it will be for trial.

(Or in this case dismissing the appeal for being premature but I mean when they hear it.)
