"Sanctions on the notary"? I don't think a trial judge actually gets to do that. The remedies are lodging a complaint with the Secretary of State's office, who might do reprimands or revoke licenses.

Chupp could sanction for illegal actions or defrauding the court, but that's not under the TCPA sanctions. It doesn't sound like Ty made an attempt to change what Vic signed, and unless Vic himself is making the claim I don't think Lemon Fuhrer gets to claim fraud.

Vic's answers are even more lawyered up than Ron's. Vic never asserts the knowledge directly nor does he relinquish his right to that knowledge(I do not recall). He uses his lawyers to give himself plausible deniability of any statements that could hurt him. While at the same time using the lawyers to give him plausible knowledge of any statement that help him.

My attorney briefed me.

Perfect statement right there, because any further questioning is behind privileged. He can claim any number of things later on about those affidavits, with out eating his own words. Ron on the other hand has to eat every single I do not recall :) :) :). I truly wish for appeal win just so I can watch this shit show burn even hotter.

If that's the case he will request the unredacted docs to review over the weekend by the end of the day. He might have done so already. But I think if that were the case all parties would be notified. I don't think they'd leave Vic in the dark for that.

The way that part read feels like a KV reach, but it could be true. I don't think the notary issue is important for a fees hearing though.

In the end it probably doesn't matter unless he reverses himself suddenly, as even the worst ruling is just getting appealed, but what a last minute twist of this OVA.

Don't think so because Chupp himself wants to make sure Vic can get his appeal through. I don't think he'd make himself personally liable for fucking that window up.

I realize, Chupp has never seen Mignona before this on testimony. He had the record of the depo, but that was it and had never interacted with him.

Optimistic, but possible. Could putting Vic ont he stand have caused some issue for MoRon? Cause if Chupp saw him testifying and felt for him, it might make him just slightly more willing to particpate.

True story I once had a roommate who was in law school ask me for help with an assignment that involved math.

No. If he didn't have jurisdiction and the appeals court did, the appeal notice was timely filed. If he retains jurisdiction until after the sanctions are decided upon, then the appeal notice is perfected after the sanctions are decided upon.

That being said, I've been informed that Chupp has "requested" unredacted billing from all defense attorneys involved, with the first calls going to Lemoine, Perez, and Casey (and these requests were in the form of an order). There may also be a surprise hearing early next week that Perez and Casey are demanded to attend.

If this really happens Chupp is gonna win madlad of the century. Like seriously, you can't even try to be as big a wildcard as Chupp has been. I'm in awe of it.
