Nope. I think he was just making the comment to Chupp when Chupp was talking about Lemoine charging five times as much as Johnson despite Johnson being the only lawyer who got out clean on the first go.

Could it be that Chupp has a problem with Vic moving his house into a trust fund? Some lawsperg said that Chupp called that "fraudulent", but that was a lawtwitter sperg, so not trustworthy.

Could Vic doing that be interpreted as fraudulent by Chupp? And if so, for what reasons? What kind of consequences could this have?

Protecting your assets seem to be a BHBC specialty so I doubt anything illegal would come of it and it would be a waste of time to pursue that.

Volney is the one person NO ONE has commented on. From what I can see, at least. We saw a minimal commentary from Johnson but imo his billing was clear and mostly fair. No real reason to ask much of him other than to pin Lemoine to the wall.

I wonder if Volney's testimony versus Lemoine's, especially with Funimation being heavily involved in the beginning under Casey, flipped a switch on in Chupp's mind.

I am probably absolutely wrong but I've wondered why we heard nothing public about Funi and Volney.

His priorities appear (from the outside looking in) so out of whack - the motion(s) to spend time on were the previous ones, NOT this one.
 
Prefacing this shit as I'm not a lawyer, but the trust issue with Vic (and I'm not at a spot with tabs for a computer).

By signing his house to his mother and she making a trust with Beard, Vic may have sought to retain control of the house. That's fine. I didn't see if he did it as revocable or irrevocable. If revocable then Monica/Ron/Jamie/Funimation can step in and revert it back, sell the house for cash. Also there was no mention (or I'm too much of a boomer to see it) if Vic funded said trust.

Chupp raising the eyebrow is because it was done after the reversal and before the fees argument. It can be seen as Vic trying to hide his shit so he can claim being broke. Regardless of how quickly he can liquidate assets, he still has them. And if he can claim no assets he may be judgement proof.

So in other words: Is this an irrevocable trust? Was it funded? And why 'after' the TCPA did it happen? Made it seem as if he was trying to hide. IMO would have been better to deed it to Mom for said trust back in May / June.

Might a lawyer check my logic here?

I hope he doesn't reverse one of his rulings. As Nick has said, the worst outcome is TI on Ron as that would delay appeal until after trial. There was something in Lemon's submissions on charges that caught Nick's attention that looked like it could force a reconsideration on TI. Perhaps it was bait. Getting a single TI charge reversed is the best outcome for Lemon.

You know the other thing that makes me press X to doubt is that Sharon did not bring that up in her paper. I am betting that would have been slipped in if true.

Her eyes might have glazed over during anything about money and math because it made her girl brain freeze up.

Replying to bump this. Notable that the claim of "Vicarious Liability" was dismissed because:
"The court (found) that Defendants have shown by preponderance of the evidence that the Defendants Marchi, Rial and Toye were Independent Contractors at all times while associated with Defendant Funimation. The Court additionally (found) that (Vic) has failed to establish, by clear and specific evidence, a prima facie case for each element of his vicarious liability claim against Defendant Funimation."
This may call that decision into question. (that said, if everything else is dismissed, I don't see how the Vicarious Liability is at all relevant anyway, but just noteworthy)

One "Hail Mary", remote possibility (highly unlikely IMO, but "possible") is a reconsideration of what is going on here. The POINT of TCPA is to prevent a person or entity from bullying defendants into silence by forcing them through prolonged legal fights they can't afford. The few excerpts and tactics that have been rumored or confirmed in this hearing seems like it should dispute that's what was going on. If anything, JSL's tactics seem clearly designed to maliciously ruin Vic financially at the end of this. I wonder if the attempt to go after Slatosch might've overplayed their hand.
