As much as I despise lemoine and his clients, Chupp did mess up several procedural issues that impact both Vic and the defendants. The defendants deserve their day in court over this but a technical issue is not necessarily a win. The COA will likely rule the TI is valid and send it back to move forward. Someone left a superchat in the stream last night citing a case that would likely override the Rule 63 issues with the 2nd amended petition so it's possible with that and the unsworn declarations on the table, they will return at least one cause of action to the district Court to hear to trial.

TRCP 296 gives him 20 days to respond, and then a notice is mandatory under TRCP 297 to preserve the failure to issue the requested findings of fact/conclusions of law for appeal. That preserves the issue for appeal and extends the deadline to 40 days after the original filing.
