You make some really good points here. This is not someone who has no income, he owns another home. The bank isn't going to let him get away with paying nothing. If Phil can't beg up the money to satisfy the bank's initial request of $15,000 (and knowing him he will, or his parents will pay it) they're not going to let him just not pay the difference between what he owes and the short sale. If he really has an IRS payment plan, at the very least he's going to add another payment plan on top of that. When they see what he makes, that won't be a tiny payment either.

But it's DSP, he'll weasel out somehow and life will go on.

I could be wrong, but I think the $15k number is just boilerplate that refers to the upper limit of what can be sought in damages in small claims court; I don't think that number has any bearing on his liability specifically.

On a side note, I'd actually love to sit in on these proceedings (law student). And I bet other Kiwis would too. Taking bets on detractors rocking up with tablets and a long list of timestamps proving his income, the contempt he holds towards the bank (and courts) and his stupid spending habits to show the court. What an absolute shit show if that ever happened.

If detractor actually tries this, at best they get ejected from the courtroom or cause it to be cleared and closed to the public. The only people allowed to speak or be part of the proceedings are the judge, the lawyers and any witnesses the lawyers agreed on beforehand.

At worst, in the outside chance that Phil secures a representative, they give that person an opening to say "your honor, these people are among the hundreds of internet trolls that have been harassing and financially terrorizing my client for five years, which has caused the unfortunate situation we are here today to discuss... "

Not to be taken as hostility, this is a legitimate question: are non-interested third parties allowed to show up and make themselves part of the proceedings in Australia?

I feel like he does this a lot and that it even happens in video games where he just doesn't understand the danger he is in. So this clip makes me curious: Is Phil lying to his audience about the issue or does he just think it's a detractor meme because he hasn't been officially notified yet? I mean, I assume he would have at least checked the document, but this news is still pretty fresh so maybe that hasn't made it's way to him. The only reason I question all this is because he's going to need CONSIDERABLY more than $2,000 and I find it odd that's all he's asking for.

Youre on the exact opposite coast of the continent, honestly probably the furthest you could get away from that property while still being on the same landmass, youre not going back to Connecticut so why are you still holding on to a property that is losing value just because you "dont want to lose money on it"?

Well, serious question here: what do you do if you're deep underwater on a mortgage and your credit is abysmal? Every mortgage I've ever seen has a provision that you can't just sell the house out from under the bank without completely paying off the mortgage - the whole point is that it's secured debt, so you're not allowed to just sell off the security and stiff the bank.
Phil would presumably have to come up with the $30K shortfall (or whatever it is) on his own, and with his credit score no one would lend him the money. He'd have to bring it upfront in cash. Obviously that's not going to happen - at least as long as he keeps paying 2 mortgages.

The only way I could see him getting out of this legitimately is just selling the WA place, moving back to CT, and living in the money pit until he either pays off or buys out his overpriced mortgage. I don't think "just sell the khando" was ever an option.

The moral: don't be an idiot when buying property, because it's easy to get into trouble and hard to get out.

Swagginz has not given any more money that I've seen (or at least nothing remotely significant). All the subs he's had were gifted and most of the times I've seen him talking in chat he was outright mocking Phil. Still a dumbass, but not as big of one.
