Depends on the evidence and the judge.
You could be Al Capone, the judge wouldn't/shouldn't care except for how that would negatively impact the health and safety of the child, but family court judges are generally given a lot of latitude.

Just being a drug user is not automatically bad; being a drug user while having custody is generally a huge problem for custody.
