Being paranoid and dramatic isn't perjury. You would have to prove he knows he'st lying. Good luck with that. I don't think Onion has a remote clue about what is true and what isn't.
Nothing is going to come of this. The judge will explain to him what he needs to get a restraining order, this notification will serve as proof that Grug doesn't want Hansen's posse on his property or near him and his family any more, but it won't matter because Hansen is smart enough to not do that again and he'll be back in New York soon. He got his knocking on the door footage and the reaction in the 911 call. That is enough. Hansen will find new ways to annoy Onion.
What needs to happen here, is an explanation of how restraining orders work, how much they cost, and what happens after one is filed, in tl;dr format. Here goes...
~ Someone calls the law, says they're being harrassed, and that individual is on their doorstep.
~ Cops show up, determine no immediate crime has been committed, advise complaintant of how to file a TRO, and then talk to both parties separately, to diffuse the situation (and suss out if further calls need to be taken seriously).
~ That person then applies for a cookie-cutter TRO (containing sworn complaint details) with the local magistrate (not a judge). These cost anywhere between $25-50, with fees waived if a crime was committed and an arrest made. Those funds come from victim restitution fines.
(If it's just a complaint with a police report, pay up)
~ If the situation is reported again, and responding officers determine that the TRO terms (which can vary) are being violated, an arrest may be made. This again, is up to the responding officers.
Now, this is the key part.....
~ An active temporary restraining order can be offered as evidence in a civil suit, but the presiding judge and any defense lawyers will look very closely at it; along with everything leading up to.
~ the existence of a TRO does not hold any criminal or civil liability. All it is, is an official "final warning". (And even then, it's often not final enough...)
~ if the defendant in the civil suit demonstrates that the statements in the TRO are blatantly false (GPS and cell records ftw), that judge has full power to find the sworn statement within the TRO to be perjurious & penalize the petitioner.
When it comes to teaching a lesson about lying on sworn statements, all judges relish the opportunity.
What's amusing is that people like Greg don't realize the "clerk" issuing and stamping their precious restraining-order is a magistrate, and they're often the ones handling calls from officers in the field, in regards to issuing an spot arrest warrant. They'll review the TRO, and if anything is shady, they'll send the officers back with more pointed questions. They do make an effort to keep people from weaponising TROs.
