[26-Mar-2020] Philip's 341 Creditor Meeting - When what should be 5 minutes becomes an eternity.

One of the things that really fascinates me is the fact that Phil didn't snort once during the 40-something-minute call with Nancy. Some throat clears I guess. Someone said it earlier in this thread, but if Phil doesn't want to snort, he won't. It's quite obvious he can control it. I have only a mortal understanding of his gouty post nasal drip so I don't know if throat clears can mitigate the need to snort.

The fact that he snorts constantly on his streams at his audience is pretty damning evidence of how much he hates them and how little he cares about his 'business'. He knows it's disgusting, he knows people hate it, but he's like 'ehh, fuck it, watch me let 'er rip' on every stream. Like I know life dealt his audience of wheelchairs a bad hand, but do they really deserve to be snorted at by a pig that can clearly control it?

I'm not saying he has to show up in business casual attire to his streams, but ffs, put a modicum of professionalism into the product you're delivering, Phil.

Snortimer really aught to invest in a radio-like audio system so he could self-mute his snorts.

Really aught to. Won't.

A thought occurred. People are really worried he will hide his tips income, but doesn't he upload the evidence to YouTube daily? Wouldn't she just be able to browse through a day of his streams, tally up the tips, and say where is this money?

This call has got me eagerly anticipating when Phil throws Rochelle under the bus in open court. I can already hear him REE'ing about how "this was how she explained to me to do this so it's not my fault I didn't mention my $5+K worth of Blu-rays or my thousands of dollars worth of collectibles, and significantly undervalued all my personal property. I was told by my lawyer I would get to keep everything!" :stress:

The whole tax on tips thing is muddying the water anyways.

Nancy doesn't give a single fuck about taxes. Phil made income on tips. All she cares about is that he's getting paid. Its irrelevant HOW he makes money, because she isnt tasked with making sure he pays his taxes correctly. Her job is strictly to look at his income and expenses and a few other things and decide if Phil gets a chapter 7 or 13 or nothing.

Dicking around answering the wrong question is still a wrong answer, she wasn't pleased.
While taxes aren’t her primary concern, they do matter. He had to submit one (and most likely three) year of returns with his petition and schedules. If Nancy discovers that his business expenses are bogus and that he used similar numbers for his taxes, she is required to submit it to the IRS for investigation. Bankruptcy trustees have broad authority to request info from a petitioner. They can ask for damn near anything during a 2004 exam. They are overseen by a US Trustee who gets involved in certain cases and also quality controls a certain percentage of cases before they receive final discharge. If they get involved, it could get ugly for Phil fast.

Philip the waiter. I can only hope his chat becomes endless permabans with messages like or 'excuse me garcon, let me speak to your manager, my water's been empty for over a half hour' or 'the service in this restaurant is terrible dood'

Also I'm seriously doubtful that @nohandsboi can actually provide good content from Phil. As bad as I want the pig to get roasted, as much as I want some entity to squeeze him for those $5k/month business expenses....CitiBank troll has already made me press X because he couldn't keep his fucking mouth shut on this forum. He had to make an account, he had to brag. He's gonna fuck it up worse than the SoK, I fear. People that chase respect and clout from random insane autistic internet people always do.

I'm worried that he'll get too greedy with pestering Phil and end up giving Phil some kind of recourse to, idk, maybe pursue some kind of legal protection? I know creditors can't harass debtors in this country, and that consumers have ... some kind of protection and recourse against harassment. CitiTroll already triggered Nancy in the call. He'll fuck it up, I just know it.

If you're gonna do dirt, fucking keep it to yourself until the opportune moment - if it ever comes, and even then. And do it alone. Don't fucking brag about it because everyone hears everything.

Real Gs move in silence like lasagne.

"There are snails........on her plate!"
No. I'm not sure how this idea that he's hiding tips has taken hold. On his monthly income and expenses filing, his listed monthly income had to have included the tips he receives unless he has some other mystery source of income that's producing thousands of dollars a month and happens to match up nearly perfectly with the amount of tips he receives in a month.
I think because there's 5k/month income missing on his paperwork and he tried to hide the Paypal accounts initially.

Being honest here - his business model wasn't that complicated. All he had to do was to transfer profit to personal account for not-related-business things such as WWE. I guess he could be more restrained from buying useless shit. It's not like he was hiring anybody else except himself, right? He wasn't issuing some invoices to different contracting parties.

He probably never spent a minute googling things about running a company or asked someone with experience what to be cautious and aware of. It is quite amusing that having all balance sheets from bank account, PayPal, Patreon and other shit he couldn't manage his finances. Like adding and subtracting is too much effort in Excel to be done quarterly.

He must be exceptional or at least "exceptional". Nobody pressed on him to do his taxes and learn how to properly sum it up... but that brings a question what his accountant had to do except collecting bank statements...
His biz is far less 'complicated' than the big deal he's trying to make it out to be. His 'tools' are already in his possession whether he bought them or someone else did and all he might have to buy is games. That's it. He has no inventory, payroll, vehicle maintenance, liability insurance, mileage recording, office expenses. Other than that, he has the same taxes as anyone else. All he has to do is keep a couple receipts of legitimate purchases and turn over any money statements.

I know I'm dropping in on this thread late, but was he seriously stupid enough to try and pull that shit? There is never any chance greater than 0 of them not finding a Paypal account with his kind of activity attached to it.

I know someone IRL who does the exact same thing. He snorts and clears his throat obnoxiously when he's around people he perceives to be inferior but the moment a superior walks in the room that shit suddenly stops. It's a weird ass powerplay.

This really reminds me of China. Anyone who has been even for a short time knows about the mainlanders' habit of public throat clearing, usually soon accompanied by spitting phlegm. Utterly disgusting of course and there are undoubtedly power move aspects to how they do it. It's peculiar to think of DSP using the same moves as a Chinese peasant; snorting and belching in the vicinity of both detractors and sincere fans alike.

His snort is an expression of dominance. He knew he was not dominant in that meeting. He was begging and pleading, even if he didn't know it. He didn't snort. I really doubt this weird man-pig-thing understands its relationship to society or other people. His snort is an expression of dominance over all that is in his domain.

He is out of his domain in a 341 meeting. The bankruptcy trustee is clearly superior to him.

He has no idea how to cope with that. But he knows that snorting is not something he can do. And he refrains from his usual pigroach dominance displays.

I am incorrect. I think he did report them but with very little to no money in them.

I knew Phil wouldn't snort during this, but he did clear his throat plenty of times. I guess there is validity to the post-nasal drip or he's just horribly out of shape fat and can't breathe well.

She'd have to be super autistic to sit through a bunch of DSP streams to tally how many dollars he gets.

And this is where DSP is going.

She'd have to be super autistic to sit through a bunch of DSP streams to tally how many dollars he gets.

No, she'd just have to be super interested in getting her percentage of whatever that is. Because she gets paid that.

She'd just have to like MONEY.

Which most people do.

There's not 5k/month missing on his paperwork. His reported monthly income matched my estimates (check the bankruptcy FAQ for the comparison, I think). But for some reason, he effectively denied the tip money income during the call, even when asked specifically about Streamlabs, which processes his tips.

I can see how he made it confusing, and you are right about the PayPal accounts. He tried to hide one and minimize both.

Or she could read the savings and loan thread and see that we've already tackled that 'tism for her.

His confuzzlement of the issue just ensured that every interested party will actually look into the issue in full detail.

More power to her then. I couldn't imagine a worse task than having to sit through a bunch of Dave's streams to chronicle every asspat he gets.

That doesn't make sense. The claim here is he makes 100k. That's 8334/mo avg. He listed his expenses at a little over 5k/mo except that June or July with the 9k spike and said he and kat together only bring in a little over 5k to end up at -$35. I'll go look at his paperwork again.

They were absent initially, then included later in an amendment.

Maybe this will clear it up, there are two $5k expenses, one business, one personal, in two of his bankruptcy documents that are easy to confuse
