Once I have time I'll read some of the documents. But one dumb question: Has it ever been verified by an independent third party doctor if Kurt had an epileptic fit? I know it's going to be relatively irrelevant for Ravioli since they still could nail him on attempt.

To me at least, that seems like it would be an awfully hard sell for the prosecution. All the defense would have to say is "well, Mr. Rivello didn't think it was actually possible to cause a seizure by posting the image." From there the prosecution would have to prove that Mr. Rivello thought it was possible, which would be very difficult to do. Additionally, I might be mistaken but Eichenwald's allegations that he actually had a seizure would be admissible as evidence for the defense. The prosecution dropping those charges would seriously discredit Eichenwald's testimony.

Though I can imagine the prosecution bringing up the DM conversations Rivello had with his buddies where he more or less said "I hope this sends him into a seizure" and "I spammed this at Eichenwald let's see if he dies". Personally I don't think Rivello was really trying to literally kill Eichenwald, but the whole "it's just a prank bro, I was being ironic" doesn't necessarily work IRL.
